In the name of God Amen I Charles Bagter of Cullumpton in the countie of Devon yeoman beinge sicke in bodye but of a perfect mynde (thankes be herefore given to Almightie God) do make this my last Will and Testament in manner and forme following

Imprimis I do committe my soule into the handes of Almightie God my creator being fullie assured that through the meritts death and passion of my onlie Savyour Jesus Xpist all my sinnes are absolutely forgiven and that I shall remayne with him in bliss for ever.

Secondlie I committ my bodye to the earth to be buried in Xpian sorte after a comely and decent manner according as myne executor shall thinke befitting

Item I give to the churche of Cullumpton aforesayd twenty shillinges

Item I give to the poore of the parishe of Cullumpton aforesayd fortie shillinges to be distributed amongst them according as my overseers and the wardens of the parishe shall see best cause

Item I do give unto my sister Thomasine Bull an annuitie of tenne shillinges during her life to be payed at the feast of the birth of oure Lord God and the Nativitie of Saint John the Baptist by equall partes every payment to be paid in the nowe dwelling house of John Penney situate and being in Exeter

And to her daughter Elizabeth I give and bequeathe tenne shillinges to be payed within a halfe a yeare of my decease

Item I give unto my sister [ ] three daughters namely Johane Dorothie and Briget three shillinges fouere pence apiece to be payed within halfe a yeare of my decease

Item I give to Johane Membery my servant twentie shillinges of good and lawfull money to be payed within halfe a year of my decease

Item I give to William Salter my servante five shillinges eight pence and allso one of my cloakes to be delivered and paye within halfe a year of my decease

Item I give to James Willey one other of my servants sixe shillinges eight pence

Item I give to John Syllye one other of my servants three shillinges and fouer pence to be payed within a halfe a year of my decease as aforesayed

Item I do give and bequeathe unto my eldest Mary Bagter the summe of one hundred poundes of good money to be payed to my said daughter Mary within twentie weekes after she shall happen to be marryed or within a quarter of a yeare after she shall accomplish the age of fouer and twenty years if she shall remayne soe long unmarried

And allso I give unto my said daughter Mary two silver bolles and one little white silver salte a half dozen of silver spoones and payer of [priginalles] one payer of [ ] otherwise greate andyrons and the furnace in the kitchen all which shall be delivered at the day of her marriage (excepting yt be one of the bolles and the little salte which shall be delivered after the decease of myne executor

Item I give and bequeath unto Margaret my youngest daughter one hundred pounds of lawfull money to be payed unto my said daughter Margaret within twentye weekes after she shall happen to be marryed or within one quarter of a yeare after she shall accomplish the age of fouer and twentie years also if she shall remayne so longe unmarryed

Item I do further give unto my said daughter Margaret a [fayer] silver tankard and a [faire] silver plate the greatest brasse panne the great spittes a greate chest with the three severall boxes halfe a dozen of the best platters and my best bed and bedstead performed one brasse bason and one copper candlestick the greate tableboard in the chamber and a greate shift which was her sistersll this to be delivered at her day of marriage or after the decease of myne executor which first shall happen

Item all the residue of my goodes not yet given nor bequeathed my debts and legaceys beyng discharged I whollie give and bequeathe unto my lovinge wife whom I make my sole and only executor and I do further bequeathe unto my sayd executor all this my living called Hayne wherein I nowe habite and dwell to have habit and enjoye the same for and during the terme of her naturall life

And after her decease I bequeath the sayed living with all and singular the appurtenances unto my said daughters Mary Johane and to [ ] the same unto the sayed Mary for and during all the residue and number of years which shall be then to come and unexpired of and in the same

Provided nevertheless and my will and meaning ys that within sixe months after the sayed Mary shall be possessed of the sayed premises that she shall then paye unto my younger daughter Margaret the summe of one hundred and fiftie pounds of good and lawfull money which said summe if the sayd Mary shall neglect and refuse to paye beyng lawfully demanded then I do ordayne that Margaret shall have the sayd living and paye unto Mary the summe of two hundred pounds within six monthes after such denyall or refusing by the sayd Mary

And my will is that yf the sayd Mary do happen to dye beyng possessed of the premises not having any yssue of her bodye lawfullie begotten to enjoye the sayd premises that then the sayd Margaret shall repaye the sayd hundred and fiftie pounds and shall have and enjoye the sayd living for and during all the residue and number of years which shall be then to come and unexpired

And my will and meaning ys that neither of my daughters uppon the losing of either of their [ ] and portions shall marrye without the consent of myne executor and overseers or one of them

And I do nominate and appoynte Richard English of Cullumpton gent and John Penney of the city of Exon clothier to be my overseers of this my last Will and Testament to see yt performed accordinglye

In witness whereof I have ratified this my Will to be made and have hereunto set my hande and seale the second daye of Aprill in the thirteenthe year of the raigne of our most gracious and sovereign Lord James by the grace of God King of England Scotland France and Ireland defender of the faith etc by me Charles Bagter
