Administration with Will annexed granted from the Archdeaconry Court of Exeter the 22nd of December 1855
Appeared personally Jenny otherwise Jane Baker of Cullompton in the county of Devon spinster in order to the due administration of the personal estate and effects the last Will and Testament of Elias Baker of Hackland in the parish of Cullompton aforesaid gentleman who died on the 16th day of July 1855
This is the last Will and Testament of me Elias Baker of Hackland in the parish of Cullompton in the county of Devon gentleman
I give and devise all that my messuage and farm called Little Hackland otherwise Peter Hills with the lands and appurtenances thereto belonging situate in the parish of Cullompton aforesaid unto and to the use of my daughter Jenny or Jane Baker her heirs and assigns forever free and clear of and from the mortgage debt of six hundred pounds and interest charged thereon which mortgage debt I charge on all my residuary real as well as personal estate and direct to be therewith and thereout paid by my residuary devisee legatee and executor hereinafter named in exoneration of the said messuage farm and lands so devised to my said daughter as aforesaid
Now I give and bequeath to my said daughter all the household goods and furniture articles and things whatsoever which I shall have at Little Hackland otherwise Peter Hills aforesaid as well as livestock at the time of my decease
Also I give devise and bequeath to her my said daughter Jenny or Jane Baker the yearly sum of twenty pounds free of all deductions to be paid to her and her assigns for her life by half yearly payments calculating from the day of my death by my son Thomas Harris Baker his heirs executors and administrators and I charge the same upon the messuages farms lands and hereditaments hereinafter by me devised to my said son
And it is my will that my said daughter and her assigns shall have full power from time to time whensoever the said yearly sum or any part thereof shall be in arrear and unpaid for the space of twenty days after any half yearly day of payment to enter upon any part of the sd messuages farms lands and hereditaments and distrain for the same as for unto reserved on common demises
All other my messuages farms lands tenements and real estate whatsoever and wheresoever situate I give and devise unto and to the use of my youngest son Thomas Harris Baker his heirs and assigns forever subject nevertheless to the payment of all my just debts and funeral and testamentary expenses and especially to the payments of the said mortgage debt on Little Hackland otherwise Peter Hills and my debt of eight hundred pounds and interest to Mr Tristram Collins Hine for which he holds a promisory note signed by my said daughter as well as myself and my said son Thomas
Also I give and bequeath to my said son Thomas Harris Baker all the residue of my personal estate whatsoever and I make him my said son Thomas Harris Baker residuary devisee and legatee and sole executor of this my last Will and Testament
In witness whereof I have hereto subscribed my name the twenty fifth day of February in the year of our Lord one thousand eight hundred and forty eight Elias Baker
Signed by the said Elias Baker the testator so and to be his last Will and Testament in the presence of us being present at the same time and we have at his request in his presence and in the presence of each other subscribed our names as witnesses R J Marker Richd Bowerman
