Proved in the Archdeaconry Court of Exeter the 19th of October 1855

Appeared personally Richard Mortimore the younger of Cullompton in the county of Devon gentleman one of the executors named in the Will and Testament or Testamentary document with one codicil of Thomas Harris Baker of Cullompton aforesaid gentleman who died on the 11th day of January 1855

Instructions for the Will and Testament of me Thomas Harris Baker of Hackland in the parish of Cullompton in the county of Devon gentleman given this eleventh day of March 1853 and which I declare shall be deemed to be my last Will and Testament until I shall make a more formal one

I give and devise unto my cousin Thomas Baker of Maiden Lane in the city of Westminster and my friend Richard Mortimore the younger of Kingsmill in the parish of Cullompton aforesaid gentleman their heirs executors administrators and assigns all and singular my real and personal estate and effects whether in possession reversion remainder or expectancy according to the several natures and properties thereof respectively

Upon trust as soon as conveniently after my decease in such manner and at such time or times as they or the survivor of them shall in their or his discretion deem fit to sell and convert into money such parts of my estate and effects as shall not consist of ready money or securities for money

And after payment thereof of my just debts funeral and testamentary expenses in trust to invest the residue upon Government or landed Securities in England with power to alter such securities from time to time as they or he shall think fit and to stand possessed thereof in trust to pay the interest dividends and annual proceeds unto my wife for her life

And after her decease upon trust to pay and divide the principal unto and between my children share and share alike their executors administrators and assigns to be vested interests in them respectively on their attaining the age of twenty one years

And in case in one or more of them shall die under that age then the share or shares of him her or them so dying as well original as accruing shall go to and be divided between the others of them in the same manner as the original shares In case only one survive to that age all to such only one

In case all should die under twenty one years then in trust to pay same as follows five hundred pounds to the children of my sister-in-law Elizabeth Godfrey share and share alike and all the residue unto my sister Jane Baker

Usual clauses as to the receipts of trustees being discharged, of indemnity, of power to change trustees

And I appoint the said Thomas Baker and Richard Mortimore the younger joint executors of my Will

Signed the day and year first written Thomas Harris Baker

Signed published and declared by the said Thomas Harris Baker as and to be his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses both being present at the same time

Further instructions for the Will of me Thomas Harris Baker before named given this twenty fifth day of May 1854

I hereby revoke the gift and devise to Thomas Baker as a trustee in conjunction with my friend Richard Mortimore the younger and I give and devise unto Mark Farrant of Growen Farm in the parish of Cullompton Devon (in substitution of the said Thomas Baker) and unto the said Richard Mortimore their heirs executors administrators and assigns all and singular my real and personal estate and effects upon the same trusts as are in my instructions for my said Will expressed. In witness my hand the day and year above written Thomas Harris Baker

Signed published and declared by the said Thomas Harris Baker as a codicil to the foregoing in his presence and in the presence of each other all being present at the same time
