Appeared personally Elias Jarman of Cullompton in the county of Devon builder executor named in the last Will and Testament of Mary Blackmore late of Cullompton the wife of James Blackmore, yeoman who died on the 5th day of July 1837
This is the last Will and Testament of me Mary Blackmore the wife of James Blackmore of Cullompton in the county of Devon yeoman which I publish and declare as follows
Whereas I am entitled to a dwelling house consisting of two tenements situate in New Street in the town of Cullompton aforesaid given me by my father who impowered me to dispose of the same notwithstanding my coverture
Now I the said Mary Blackmore do hereby give and bequeath unto Elias Jarman of Cullompton aforesaid builder all that my said leasehold dwelling house consisting of two tenements with the gardens and outhouses thereto belonging called Pearceys situate in the New Street of the town of Cullompton afsd now occupied by Joseph Way and Henry Down to hold this same with the appurts unto the said Elias Jarman his exors admors and assigns upon the trusts and for the purposes hereinafter declared (that is to say)
Upon trust that he the said Elias Jarman his exors admors and assigns do and shall with all convenient speed after my decease absolutely sell and dispose of my said leasehold dwelling house and gardens and premises by public auction or private contract to any person or persons willing to purchase the same for the best price or sum of money that he the said Elias Jarman his exors admors or assigns shall be enabled
And for facilitating such sale do and shall enter into make and execute all such contracts covenants or agreement conveyances assignments and assurances as he the said Elias Jarman his exors admors and assigns shall think proper
And I do hereby declare my will to be that they said Elias Jarman his exors admors and assigns shall stand possessed of the monies arising from the sale hereinbefore directed to be made
Upon trust to pay within three months after my decease or as soon as possible after such sale into the hands of John Blackmore and Ann Blackmore son and daughter of my daughter Sarah Blackmore the sums of £15 each to and for their own respective separate use and benefit
Then upon trust to pay and divide the clear residue of the monies arising from the said sale and the rents of the said premises remaining in the hands of the said Elias Jarman his exors admors and assigns (after payment of the said legacies my just debts the expenses of proving this my Will and all reasonable expenses attending the executorship to and between Thomas Blackmore my son and my daughters Betty Leach (the wife of Thomas Leach) and Mary Leach widow to and for their sole and separate use and benefit separate and apart from their present or any future husband either of my daughters may happen to marry without being liable to their debts control or engagements
And I hereby declare that the person or persons who shall purchase money to the said Elias Jarman their exors admors or assigns shall not be obliged to see to the application or be answerable for the misapplication of the same and that every receipt which shall be given by the said Elias Jarman his exors admors or assigns for the said purchase money or any part thereof shall be an effectual discharge to the person or persons paying the same and for such money as in such receipt is expressed to be received
And lastly I hereby further declare that it shall be lawful for the said Elias Jarman to reimburse himself out of such monies as may come into his hand by virtue of these presents all reasonable costs and expenses to be incurred by him in the trusts aforesaid or in relation thereto
And I appoint the said Elias Jarman exor in trust for fulfilling the purposes of this my Will and I hereby revoke all former Wills by me heretofore made and do declare this present writing contained in two sheets of paper to be my last Will and Testament
In witness whereof I the said Mary Blackmore the testatrix have to foot of the first sheet set my hand and to this last sheet my hand and seal this twenty first day of September in the year of our lord one thousand eight hundred and thirty Mary Blackmore
Signed sealed published and declared by the said Mary Blackmore the testator as and for her last Will and Testament in the presence of us who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses
