Appeared personally Henry Matthews of Cullompton in the county of Devon, plumber and glazier and William Toogood of the same place clerk of the Cullompton Bank the executors in trust named in the last Will and Testament of William Burnard late of Cullompton aforesaid maltster deceased who died on 28th day of March 1834
This is the last Will and Testament of me William Burnard of Cullompton in the county of Devon malster
First I give devise and bequeath unto Henry Matthews of Cullompton aforsd plumber and glazier and William Toogood of the same place clerk of Cullompton Bank all my messuages lands dwelling houses & pres monies securities or money and every thing that I may die possd of requesting them as soon as convenient after my decease to sell and dispose of the same except the house and premises commonly called or known by the name or sign of The Kings Head in in Cullompton aforsd and place the amt of the same out on good security in trust as follows
First I give and bequeath unto my son Daniel Burnard the sum of £80 to be pd him within six months after my decease and I hereby charge all that I may die possd of to and with the payment of the same
I give and bequeath all that I may die possd of after payment of the sd sum of £80 and also my just debts funeral expenses and the expense of proving this my Will unto my grandchildren William Thomas John Daniel Henry Sarah and Jane Burnard sons and daurs of my late son Thomas to be divided between share and share alike as they attain their respective ages of 21 years but in case either of them should die before he or she has attd his or her age of 21 years as aforsd and without issue then I give and bequeath his or her share unto the survivors of them share and share alike
And my will and mind is that Sarah Burnard widow of my sd son Thos shall be permitted to remain in the possession of the sd Kings Head Inn free of any rent during her lifetime or as long as she shall remain my sd son Thomas’s widow
And from an immediately after her disease or intermarriage then I direct them the sd Henry Matthews Wm Toogood to let the same and the rents and profits arising therefrom I give and bequeath the same unto my sd grandchildren share and share alike
And lastly I do hereby nominate constitute and appoint them the sd Henry Matthews and Wm Toogood exors in trust of this my Will and I do hereby direct that my said exors and trustees shall each of them be answerable for his own acts and receipts only and not the one for the other of them and that they shall not be answerable for any loss by any security or securities that may happen in or about the execution of the trust hereby in them reposed and also that they shall retain all their costs charges and expenses out of the effects in them resply vested in and by this my Will
In witness whereof I have to this my last Will and Testament contained in two sheets of paper set my hand and seal this twenty eighth day of February one thousand eight hundred and thirty four William Burnard
