Proved July 1st 1840 in the Archdeaconry Court of Exeter
Appeared personally Elias Jarman of the parish of Cullompton in the county of Devon builder and Thomas Wolland of the same place maltster the executors in trust named in the last Will and Testament of Robert Coleman late of Cullompton aforesaid yeoman deceased who died on the seventeenth day of April 1840
This is the last Will and Testament of me Robert Coleman of Cullompton in the county of Devon yeoman
First I give devise and bequeath unto Elias Jarman of Cullompton aforesaid builder Thos Wolland of the same place maltster all my live and dead stock household goods and furniture monies securities for money and every thing that I may die possessed of in trust as follows
I give and bequeath immediately after my decease unto my son John one hundred pounds worth of live and dead stock to be taken at the valuation which has been recently made
I give and bequeath unto my son Francis the sum of one hundred pounds
I give and bequeath unto my son William the sum of one hundred pounds
I give and bequeath unto my daughter Elizabeth the sum of eighty pounds
I give and bequeath unto my daughter Mary the wife of John Hartnell the sum of eighty pounds
I give and bequeath unto my daughter Ann the sum of eighty pounds
I give and bequeath unto my daughter Martha wife of Robert Melhuish the sum of eighty pounds
I give and bequeath unto my daughter Maria the sum of eighty pounds which said legacies shall be paid within twelve months after my decease and I hereby charge all that I may die possessed of to and with the payment of the same
And as to all the rest residue and remainder of my live and dead stock and effects of what nature or quality the same may be after payment of the said legacies my just debt funeral expenses and the expense of proving this my Will I give and bequeath the same unto my two sons Robert and James share and share alike
But in case either of my said children should die unmarried within twelve months next after my decease then I give his or her share and the survivors of them share and share alike
And I direct that my exors and trustees shall be at liberty at the expiration of twelve months next after my decease to take possession of all or any of the live and dead stock that I give unto my two sons Robert and James and sell the same for the payment of the said legacies if the same be not paid or ample security given for the same
And it is my request that my said sons Robert and James may be allowed to farm all the lands that I am now in possession of except Heathallers and the Scabbertons which I request by son John may be allowed to farm
And it is my particular request that my said daughter Elizabeth may be allowed to remain with my said two sons Robert and James trusting they will take every possible care of her but in the event of her not being treated comfortably I do hereby direct that my sd two sons Robert and James shall pay unto my said daughter the Elizabeth the sum of five pounds per annum by four equal quarterly payments to commence from the day of her being obliged to leave them
And lastly I do hereby nominate constitute and appoint them the said Elias Jarman and Thomas Wolland executors in trust of this my last Will and Testament and my will is and I do hereby direct that my said executors and trustees shall each of them be answerable for his act and receipts only and not the one for the other of them and that they shall not be answerable for any loss or miscarriage by any security or securities that may happen in my estate and also that they shall retain all their costs charges damages and expenses out of the estate and effects in them respectively vested in and by this my Will and the trusts therein contained
In witness whereof I have to this my last Will and Testament sets and subscribed my hand and seal this twenty first day of July 1837 The mark of Robert Coleman
Signed sealed published and declared by the said testator Robert Coleman as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other of hereunto subscribed our names as witnesses thereto
