Administration with Will annexed Penelope Crudge of same widow, Robert Baker the elder the sole executor having died without proving the said Will and the representative of the said Robert Baker having refused the burthen and execution thereof
Proved in the Registry of the Archdeaconry of Exeter the 26th May 1817
Penelope Crudge of Cullompton in the county of Devon, widow administratrix with the last Will and Testament of Richard Crudge late of Cullompton aforesaid, gentleman who died on the twelfth day of July 1813
This is the last Will and Testament of me Richard Crudge of Cullompton in the county of Devon gentleman in manner following that is to say
I give devise and bequeath all and singular my freehold chattlehold and leasehold messuages lands tenements hereditaments estates and premises whatsoever and wheresoever situate lying and being (subject nevertheless to the jointure of Penelope my dear wife for her life on such parts thereof as she may be intitled unto under our marriage settlement made previous to our marriage) with their rights members and appurtenances and all my estate rights title interest property claim and demand both at law and in equity of into or out of the same or any part there are and also all and singular my chattles and personal estate whatsoever unto my friend Robert Baker the elder of Cullompton aforesaid esquire his heirs exors admors and assigns forever
And I do hereby make and appoint the said Robert Baker the elder whole and sole executor of this my Will upon trust nevertheless and to and for such use and uses ends intents and purposes and under such provisoes declarations and directions as are hereinafter mentioned concerning the same (that is to say)
Upon trust in the first place thereout and therewith to pay and discharge all my just debts and funeral expenses and subject thereto upon trust that the said Robert Baker the elder his heirs exors admors and assigns shall and do after my decease in the meantime and until Robert Baker the younger (son of the said Robert Baker the elder) shall attain his full age of twenty five years receive the rents issues profits dividends and interest of all and singular my said estates and effects hereby by me given devised and bequeathed and every part thereof and pay apply and dispose of the same from time to time (subject as aforesaid) to and for the said Robert Baker the younger in and about his education maintenance and benefit in such manner as he the said Robert Baker the elder his heirs exors admors and assigns shall in his or their discretion think fit
And from and immediately after the said Robert Baker the younger shall attain his age of twenty five years then as to all and singular my said estates and effects hereby by me given devised and bequeathed upon trust for the said Robert Baker the younger his heirs exors admors and assigns forever to and for his and their only use and benefit
But in case the said Robert Baker the younger shall die under his age of twenty five years then from and immediately after such his death upon trust as to all and singular my said estates and effects hereby by me given devised and bequeathed to and for the only proper use and behoof of the said Robert Baker the elder his heirs exors admors and assigns forever to and for his and their own benefit and advantage
And I do hereby revoke all former will and wills by me heretofore made and declare this to be my last Will
Provided always and I do hereby direct that the said Robert Baker the elder his heirs exors admors and assigns shall and may reimburse pay and satisfy himself and themselves by and out of the said trust estates and premises and effects hereby by me devised given and bequeathed to him and them upon the trusts aforesaid all such costs charges damages losses and expenses whatsoever which shall or may in any manner howsoever happen or arise to or be paid by him or them in or about the trusts of this my Will or any way concerning the same
And lastly I do hereby empower they said Robert Baker the elder his heirs exors admors and assigns after my decease and until the said Robert Baker the younger shall attain his full age of twenty five years to let and demise at yearly rack rent all the said trust estates and premises to any person or persons whomsoever for such term or years not exceeding ten years and also to lend all the said trust monies or any part thereof at interest to any person or persons whomsoever and on such security or securities as the said Robert Baker the elder his heirs exors admors or assigns shall in his or their discretion think fit and to pay and apply the said rents and profits thereof and the said interest thereof to and for the said Robert Baker the younger until he shall attain his said age of twenty five years in manner hereinbefore directed and afterwards to the person or persons who shall or may be intitled to the same as aforesaid under this my Will
In witness whereof I the said Richard Crudge the testator have to this my last Will and Testament contained in two sheets of paper to each sheet set my hand and seal this thirtieth day of July in the year of our Lord one thousand eight hundred and eleven The mark of Richard Crudge
