The eighteenth day of October 1635
In the name of God Amen I John Driver now of Collumpton in the countie of Devon gent being very weake and sicke of body but thanks be to Almighty God in good and perfect memory doe make and ordayne this my last Will and Testament in manner and forme following
Imprimis I give and bequeath my soule to Almighty God my maker and redeemer and my body to Christian buriall at Taunton St. Magdalen churchyard by my father
Item I give and bequeathto Mr Pecke minister of God’s word of Cullumpton twentie shillings or a new gowned clothe to preach my funeral and unto Mr Newton of Taunton also minister there the summe of twentie shillings
Item I give and bequeath to the poore of Taunton xxs and to the poore of Collumpton also twentie shillings
Item I give and bequeath unto Richard Gaye my brother in lawe all that house tenement and purtenance called The Angell in Taunton and all the right and interest which forever I have therein
Item I doe alsoe give and bequeath unto the said Richard Gaye my brother in law all the right and interest whatsoever I have in one house one orchard one close of land with the appurtenance lyeing in the parrish of Wilton
Item I doe give and bequeath unto my mother Anne Gardner fortie shillings a yeare during her life to be paid by the said Richard Gay yearely during her life
Item I give and bequeath unto my brother in law Christopher Boone if it please God to send him home out of Spayne into England one hundred pounds sterling to me due by Nicholas Bennett of Wilton on Ladyday next and yf he shall happen to dye before that this hundred pounds become due and that then my will is that he the said Richard Gaye my brother in law shall have the same to his use
Item I give and bequeath unto [ ] Colliprist twentie shillings and unto Anstice England twentie shillings and ten shillings to Mary Bannton the daughter of Arthur Bannton
All the residue of my goods & chattells lands and tenements not before given and bequeathed I give and bequeath unto the said Richard Gaye my brother in law whom I doe make my whole and sole executor of this my last Will and Testament revoking all former Wills gifts and legacies whatsoever
And I doe desire Thomas Prouse Henry Hussey and Valentine Gardiner gent to be my overseers of this my last Will and Testament and for their paynes taken therein I doe give to each of them fyve shillings apiece
