Proved 13h October 1857 in the Archdeaconry Court of Exeter
Appeared personally Richard Way of the parish of Cullompton in the county of Devon weaver the sole executor named in the last Will and Testament of John Flood of the said parish of Cullompton mason who died on the third day of August 1857
I John Flood of Cullompton in the county of Devon mason hereby revoking former Will or Wills and bequests by me at any time made do make this my last Will and Testament in manner following that is to say
I give devise and bequeath unto my beloved wife Sarah Flood the whole of the property I shall die possessed of both real and personal of whatever description and wheresoever the same may might be for her sole and separate use and benefit for and during the term of her natural life subject however to the payment of all my just debts funeral and testamentary expenses and I hereby charge this bequest to my beloved wife with the full and honorable discharge of the said debts and expenses
And from and after the decease of my said wife I give devise and bequeath unto my son Samuel Flood his heirs executors administrators and assigns all those five dwelling houses and premises thereto belonging lying and situate in New Street in the town of Cullompton aforesaid and now in the occupation and tenure of myself John Mordle John Westacott James Manning and one at present unoccupied
Also those five dwelling houses and premises thereto belonging situate and lying on the west side of the Exeter Road in the said town of Cullompton and now in the occupation and tenure of William Cross Henry Brooks Robert Brooks Richard King and Joseph Mitchell
Also I give and bequeath unto my friend Richard Way of Cullompton aforesaid weaver in trust for the sole and separate use and benefit of my daughter Ann Palmer wife of Robert Palmer of Oundle her heirs executors and administrators and assigns all those two dwelling houses and premises situate in Crow Green in Cullompton aforesaid in the occupation of Robert Ward and Sarah Cross
Also all those three cottages and premises situate in Clampitts in Cullompton in the occupation of James Blackmore Robert Cook and Maria Toogood
Also all that orchard and premises in Clampits aforesaid now in the occupation of James Sanders
Also all that dwelling house and premises on the Exeter Road aforesaid in which the said James Sanders now resides
Also all those five cottages or dwelling houses and premises now in the occupation of Benjamin Rutley Ann Yeo Charles Brook Sarah Whitehouse and Richard Needs
And as to such of my household goods and furniture and all other my personal property that might remain undisposed of at the time of the decease of my said wife Sarah Flood I hereby give and bequeath to my said son and daughter share and share alike to be equally devided between them by my said friend Richard Way
And lastly I hereby constitute and appoint my friend the said Richard Way as sole executor of this my last Will and Testament
In witness whereof I the said John Flood have hereunto set my hand this eighteen day of December one thousand eight hundred and fifty two X the mark of John Flood
Signed by the above named John Flood as and for his last Will and Testament in the presence of us present at the same time who in his presence and in the presence of each other have hereunto subscribed our names as attesting witnesses thereto
