Proved 23rd December 1851 in the Archdeaconry Court of Exeter

Appeared personally Robert Burrow of Cullompton in the county of Devon solicitor one of the executors named in the last Will and Testament of Sarah Foster late of Cullompton aforesaid widow deceased who died on the 24th day of July 1850

This is the last Will and Testament of me Sarah Foster late of Knapp in the parish oof North Cury in the county of Somerset but now of Cullompton in the county of Devon widow made this twenty eighth day of February one thousand eight hundred and forty eight

I charge all my personal estate and effects whatsoever and wheresoever to and with the payment of all my just debts funeral and testamentary expenses

And subject thereto I give and bequeath all my right title interest and benefit of and in two several policies of insurance one on my own life effected by Mr Upton for two hundred and fifty pounds to secure to him on my decease two hundred pounds and interest and the other policy on the life of Rachel Foster then spinster but since married of North Curry aforesaid for two hundred pounds payable on her death

And also of and in the sum of forty five pounds or thereabout being the balance of an account due to me from my son Samuel Foster unto my sons in law Robert Burrow of Collumpton aforesaid solicitor and John Simmons of Taunton in the county of Somerset Wesleyan Minister but nevertheless upon the trusts hereinafter mentioned (that is to say) subject as aforesaid

Upon trust to pay or allow unto my said son Samuel the said sum of forty five pounds or such part thereof as shall be due from him to me at the time of my decease

Also to pay to my daughter Harriet the wife of Thomas Newton of Wiveliscombe in the said county of Somerset ironmonger the sum of one hundred pounds

Also to pay to my daughter Ann the wife of him the said Robert Burrow the sum of fifty pounds

Also to pay to my daughter Eliza the wife of Frederick Richmond of Taunton in the said county of Somerset late draper the sum of twenty pounds

Also to pay unto my grandsons John Simmons the younger and Samuel Simmons the sons of my said son in law John Simmons the sum of eighty pounds to be equally divided between them my said grandsons share and share alike

All the residue of my real and personal estate if any I give unto my said daughter Ann

And I hereby appoint my said sons in law Robert Burrow and John Simmons joint executors of this my will and I hereby declare that they shall not be answerable one for the other of them and that neither of them shall be answerable for any more monies then shall actually come to his hands by virtue of these presents and that if either of them in the exercise of his profession or trade shall transact any business relative to the said Trusts he shall be entitled out of the said Trust monies to his full professional or trade charge and allowances and not merely to his bare charges and expenses out of pocket

And I hereby revoke all other Wills by me at any time heretofore made and do declare this present writing to be my only last Will and Testament In witness whereof I have hereunto set my hand the day and year first above written Sarah Foster

Signed and declared by the said Sarah Foster the testatrix as and for her last Will and Testament in the joint presence of us who in her presence have subscribed our names as witnesses thereto this twenty eighth day of February one thousand eight hundred and forty eight
