Estate Duty Office Will of Henry Frost late of Cullompton, Builder (1821)

Proved in the Registry of the Archdeaconry of Exeter the 16th of February 1821

Mary Frost of Cullompton in the county of Devon widow and Henry Matthews of same place plumber the joint executrix and executor named in the Will of Henry Frost of same place builder deceased who died on the 23rd day of September 1820

This is the last Will and Testament of me Henry Frost of Cullompton in the county of Devon builder made this twenty third day of September in the year of our Lord one thousand eight hundred and twenty

I give devise and bequeath unto my dear wife Mary Frost and to Henry Matthews the younger of Cullumpton aforesaid plumber and glazier all and singular my household goods and furniture monies and securities for money and all other my estate and effects of what nature or kind soever or wheresoever situate upon trust as here in after mentioned (that is to say)

Upon trust in the first place to pay and satisfy all my just debts and funeral and testamentary expenses

And after payment thereof upon trust to pay deliver and make over the residue thereof until and to and for the only use and benefit of my said wife Mary Frost her executors administrators and assigns

And I will and declare that they might said trustees and the survivor of them and his or her executors and or administrators shall as soon as conveniently may be after my decease cause an inventory of all and singular my estate and effects to be taken and made and shall by public auction or private contract dispose of thereof or of such part thereof as shall be necessary for the purpose of paying off and discharging by just debts funeral and testamentary expenses

And I will and declare that the one of my said trustees shall not be answerable or accountable for the acts deeds or receipts of the other of them but each of them for his or her own acts deeds receipts or defaults only nor shall my said trustees or either of them be charged or chargeable with or for any more monies than shall actually and respectively come to his or her own hands by virtue of this my Will nor shall they my said trustees be answerable or accountable for any involuntary loss that may happen in the execution of this my Will or the trusts thereof or anything relating thereto

And I further will and direct that it shall and may be lawful to and my said trustees and each of them by and out of the monies that shall come to them or either of their hands by virtue of this my Will to retain to and reimburse himself and themselves respectively all such costs charges losses and expenses as they are either of them shall be put unto lay out sustain or expend in or about the execution of this my Will

And I do hereby nominate constitute and appoint my said wife Mary Frost and the said Henry Matthews the younger joint executor and executrix of this by last Will and Testament hereby revoking all forms or Will and Wills by me at any time heretofore made ratifying and confirming this alone to be my only true last Will and Testament

In witness whereof I the said Henry Frost the testator have to this my last Will and Testament set my hand unseal the day and year first written Henry Frost

Signed sealed published and declared by the said Henry Frost the testator as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses hereto
