Proved 9th June 1843 in the Archdeaconry Court of Exeter
Appeared personally Thomas Turner of Cullompton in the county of Devon weaver and Richard Way of Cullompton aforesaid, weaver the executors named in the last Will and Testament of Samuel Fry of the parish of Cullompton aforesaid sergeweaver deceased who died on the 8th day of May 1843
This is the last Will and Testament of me Samuel Fry of Cullompton in the county of Devon sergeweaver which I publish and declare as follows
I give unto my grandson William Clapp the sum of nineteen guineas
To my grandson George Fry Mitchell I give the like sum of nineteen guineas
And to my granddaughter Elizabeth Melhuish the wife of John Melhuish of Cullompton aforesaid carpenter I give the sum of nineteen guineas to be for her sole and separate use free from the debts control or engagements of her present or any future husband and I hereby declare her receipts alone shall be a sufficient discharge to my executors
Which said several legacies I direct to be paid by my executors hereinafter named at the expiration of three calendar months next after my deceased
All the rest residue and remainder of my goods chattels money and securities for money debts and all other my personal estate and effects whatsoever and wheresoever except as hereinafter mentioned (after payment of the legacies given by this my Will and all any just debts funeral and testamentary expenses) I give and bequeath unto my daughters Melony Way the wife of Richard Way of Cullompton aforesaid weaver and Sarah Stamp the wife of Edmund Stamp of Honiton in the said County saddler to be equally divided between them share and share alike
And I hereby declare that the legacies so given to my said two daughters shall be for their sole use and disposal respectively and not be in anywise subject to the debts control or engagements of their present or any future husband either of them may happen to marry and that their receipts alone respectively shall be a good discharge for the same
I give and bequeath to the Wesleyan Methodist Society in Cullompton aforesaid the sum of five pounds sterling to be paid out of my personal estate by my executors for the general purposes of the said society for which legacy the receipt of the treasurer for the time shall be a sufficient discharge
And whereas on my marriage with my present wife Hannah I became legally possessed of and entitled to all her personal estate now I hereby give and bequeath the same unto my wife Hannah her executors administrators assigns to and for her own use and disposal
I give to my said wife during her life all my household goods and furniture and one decent suit of mourning after her decease I give the same to my said daughter Melony Way
And I hereby empower my executors to give receipts for money paid them and also to compound debts which receipts shall discharge the person taking the same from all liability to see to the application of the money
And I hereby appoint Thomas Turner of Cullompton in the said county weaver and the said Richard Way joint executors of this my Will hereby revoking all former and other Wills In witness whereof I have hereunto set my hand this twelfth day of December one thousand eight hundred and forty two
