In the name of God Amen I Richard Gaye of Collumpton in the countie of Devon chyrugion being weake and sick of bodie but of good perfect and disposing memorie thankes be given unto Almightie God for the same doe make and ordaine this my last Will and Testament in manner and forme following that is to say

I doe hereby most humbly and heartily desire to commit and commend my soule and spirit into the hands of God that gave it my Saviour and most mercifull Redeemer and my bodie unto the dust from whence it came by a decent and Christian burial

And all my goods lands and chattells which God have blessed mee with all I doe dispose in manner & forme following (that is to say)

Imprimus whereas Thomas Risdon of the Inner Temple London esqr and Henry Skinner of Collompton aforesaid yeoman deceased by their deed indented dated the twentieth day of October in the fourteenth yeare of the late Queen Elizabeth over England etc did among other things demise grant and to farme let unto John Davie late of Stockland in the countie of Dorset gent deceased all those closes or parcels of land meadow and pasture with the appurtenances situate in Collompton aforesaid hereafter in those presents particularly named and expressed (that is to say)

All that tenement or cottage with the appurtenances and all that parcell of land lying on the north and west parts of the mansion nowe sometimes in the tenure of Thomas Way and John Blackwell containing by estimation one acre one parcell of land or meadowe called by the name of the Hiraller alias Heathaller containing by estimation one acre and a yard of ground adjoining unto a certaine meadowe called Were Meadow and one little plot of ground lying at Crowe Green within the sd towne of Cullumpton aforesaid and one messuage called or knowne by the name of Marshall’s house situate likewise within the towne aforesaid and one close or parcell of and with the appurtenances comonly called or known by the name of the Crosse close containing by estimation three acres and halfe or thereabouts being bounded with the lands belonging unto Brooke tenement on the west of the lands of George Mudford on the east

To have and to hold all and singular the said closes and premises with the appurtenances (except as in the said recited deed is excepted) unto the said John Davie his executors administrators and assigns unto the full end and terme of three thousand years years without impeachment of wast the same term to commence immediately upon the expiration of certaine particular estates of and in the promises before that tyme granted by John late Abbott of the late dissolved monastery of Buckland and convent of the same and by Sir John St Leger Knight unto severall persons in the said verified deed name since which tyme the said estate and terme of three thousand years years of and in the promises and other things in the said recited deed granted unto the said John Davie by good and sufficient assurance and conveyance in the lawe and by several means or assignments which granted and conveyed unto Richard Gaye my father deceased nowe by his last Will & Testamt in writing bearing date the twentieth day of September in the fifth yeare of the reigne of the late King Charles over England did give and bequeath the same unto mee the said Richard Gaye his sonne and thereof did likewise make and ordaine me sole executor and shortly after dyed After whose death I the said Richard Gaye made probate of the same Will in due forme of lawe and by virtue thereof entered into and was possessed of all the said closes and parcells of land and promises for and during the residue of the said term of three thousand yeares as then to come and unexpired

Nowe I doe hereby give and bequeath all that the before named parcell of land or meadow called Hiraller or Heathaller with the appurtenances situate as aforesaid unto Richard Maning sonne of Thomas Maning of Collompton aforesaid to have and to hold unto him the said Richard Maning his executors administrators and assignes for and during all the residue and remainder of the said terme of the three thousand yeares yet to come and unexpired of and in the same limited or granted in and by the said verified deed of the said Thomas Risdon and Henry Skynner and in soe large and ample manner to all intents and purposes as I the said Richard Gaye the sonne can or may give grant or bequeath the same without impeachment of wast

Provided that if the said Richard Maning shall not live or attaine to the age of one and twentie years then my will and my intention is that the said parcell of land or meadow called Hirkaller shall remaine unto Anne Maning my sister during the terme of fourscore and nyneteen yeares if shee shall soe long live

And after her decease I give and bequeath the same during the residue of the said terme of three thousand years years unto such other children or sonnes & daughters as shee the said Anne shall have surviving at the tyme of her death

Item I give and bequeath unto the said Anne Maning my sister to the

intent I may have a decent buryall all that one close or parcell of land before named called the Crosse close now in the manurance and occupation of Henry Howe of Collompton aforesaid dyer to have & hold unto her the said Anne her executors administrators and assignes for the residue of the said terme of three thousand years years therein yet to come and unexpired

Item I give and bequeath unto the said Anne Maning my sister for the intent and purpose last before mentioned all that close or parcell of land lying at or near Longbridge called Cogland to have and to hold unto her the said Anne Maning her heires and assignes forever

Item I doe hereby give and bequeath unto Humfrie Gaye of the parish of Gidley in the said county at Devon clerke my brother all that messuage or dwelling house wherin I nowe inhabit (the kitchin and kitchin chamber thereof wth I doe hereby give and bequeath unto the said Anne Maning onely excepted) to have and to hold unto the said Humfrie Gaye for the terme of four score and nynteene years if hee shall soe long live

And after his decease I doe hereby give and bequeath the same unto William Gaye Thomas Gaye Mary Gaye Elizabeth and Sarah Gaye sonnes and daughters of the said Humfrie Gaye to have and to hold unto them their executors and assignes for the residue of the said terme of three thousand years as yet to come and unexpired the same terme hereby given to commence immediately upon and after such estate or terme of yeares as is thereof heretofore granted unto the use of Alice my wife

Item I give and bequeath unto Roger Mosey Humfrie and Thomasine Mosey John Borough Anthony and Mary Borough children of Mary Borough my sister twelve pence apiece

Item I give and bequeath all my movable goods household stuff utensills of household unto Susanna Gaye and Phillipp Gaye my daughters to be equally divided betweene them

Item I give and bequeath unto the said Humfrie Gaye my brother all such my lands goods immovable chattells whatsoever not herein before given or disposed lymited or bequeathed whom I make sole executor of this my last Will and Testament

In witness thereof I have here unto put my name and seale and published this my last Will and Testament revoking all former Wills whatsoever
