Will of Thomas Gird or Gyrd late of Cullompton, Clothier

In the name of God Amen the one and twentith daie of January in the three and fortieth yeare of the raigne of our Soveraigne Ladie Queene Elizabeth etc. Anno domini one thousand sixe hundred I Thomas Gird of Colompton in the countye of Devon clothier beinge of perfect minde and memorie make this my Testament conteyninge my last Will in manner and forme following

First I bequeathe my soule to Almightie God and my bodie to be buried in Mr Lanes Ile within the church of Colompton

Item I give to the store of the same churche sixe shillings & eight pence

Item I give to the poore of the same church twenty shillinges

Item my will and minde is that Anne my wife shall have the use and occupation onely and not otherwise of all the seelinges tablebordes bedsteads cupboards and glass that is and shall be at the tyme of my decease in my dwellinge house at Colompton for and during her naturall life and not otherwise

And I give and bequeathe unto the saide Anne my wife all my corne within door and without haye wood and all household stuffe and utensils of house plate pewter beddinge naperie and such like

And also all my cattell and horses mares geldings coltes oxen bullocks [ ] heifers yearlings pigges and such like goodes to dispose at her will and pleasure

Item I give and bequeathe to Anne my daughter one hundred pounds of lawfull money of England to be paide at the ende of fouer yeares next after my death

And to Bridgett Troke my wife’s daughter the summe of fiftie pounds in money to be paide at the ende of sixe years next after my death

But if either of them shall happen to marrie at anie tyme before the saide severall tymes of payment then my will is that the legacie of each of them that shall soe marry shall be paide at the ende of one halfe yeare next after the severall marriage of either of them

Item I give and bequeath to Mary Rattcliffe my daughter tenn pounds to be paide within three years next after my decease

Item I give and bequeath to each of my two sonnes John and Henry Gird the younger the summe of twentye poundes apiece to be paid to each of them within three yeares next after my death

Item I give and bequeath to Daniell Gird my sonne the summe of fiftie pounds in money to be paide alsoe within three yeares next after my death

Item my will and minde is that Thomas Troke my wife’s sonne shall likewise have the use and occupation only after the decease of Anne my wife of all the seelinges tableboardes bedstead cupboards and glass that is and shall be in my dwellinge house in Colompton aforesaide at the tyme of my death for and during the naturall life of the said Thomas Troke and after the decease of the said Thomas Troke I give and bequeath the same to Henry Gird the elder my sonne and heire and to his heires forever

The residue of all my good cattells chattells and debts whatsoever movable and unmovable not given nor bequeathed I give and bequeathe to the saide Henry Gird the elder my sonne whome I doe nominate appoint and make my whole and sole executor of this my last Will and Testament he to accomplishe and performe this my testament and alsoe to performe and accomplishe other matters with the good of some of my other children as is betweene him and me agreed uppon as my wholle truste is in him

Also my will is that if the saide Anne Gird my daughter happen to die before the daie aforesaide appointment for payment of the saide hundred poundes to her given then I give and bequeathe the one half of the saide hundred pounds to Debora my daughter wife of Thomas Rabjohn theother half to my saide sonne Henry Gird the elder

Item I give to James my sonne over and above the annuitie which I doe provide for him the summe of tenn shillinges in money

Item to the said Debora my daughter twenty shillings

And I doe desire my lovinge friends John Thomas and John Bartlett gent and Thomas Trosse to be my overseers to assiste myne executor and I give to eche of them twenty shillings

And I doe revoke and make frustrate all former testaments legacies and devises by me heretofore made

In witness whereof I have acknowledged this to by last Will and Testament and thereunto have subscribed my name in the presence of the aforesaide John Bartlett and Thomas Trosse and of William Smith servant to the said Jo Bartlett

A codicill conteyning an alteration of some part of the Testament or last Will of the saide Thomas Girde expressed and declared by word of mouthe by the saide Thomas Gird beinge in healthe of body and perfect memorie in or neare about the three and twentithe daie of Aprill Anno Domini one thousand sixe hundred and seaven in the presence of John Bartlett gent who was a witness and overseer named in his saide Testament and of Thomas Trosse and in the presence alsoe of Anne Girde his wife and of the above named Henry Girde his executor and Rebecca his wife as follows in effect vizt.

Imprimis he did declare that he had received divers hinderances and had taken losses whereby his estate and stocke was abated since the makinge of his sayde Testament and that therefore the legacyes by him bequeathed in his sayed Testament were over greate and too many

And therefore whereas he had bequeathed by his sayde testament unto Anne Gyrde his daughter the summe of a hundred pounds nowe his will was to abate thereof twenty poundes and did give and bequeath unto her only fouer score poundes thereof

Item whereas he had bequeathed to Daniell his sonne the summe of fiftie pounds his will was to abate thereof the summe of thirtie poundes and did give unto him thereof only twentye poundes

And lastly whereas in his sayde Testament he had bequeathed unto John Girde and Henry Gyrde the younger his sonnes eache of them twentye pounds apiece he did make both those legacies voyde and his will was that they should have noe part thereof or to the same effect
