Proved in the Principal Registry of the Lord Bishop of Exeter 19th day of May 1848

Appeared personally Samuel Fowler of Cullompton in the county of Devon baker the sole executor named in the last Will and Testament of George Godfrey late of Cullompton aforesaid gentleman who died on the 30th day of April 1848

This is the last Will and Testament of me George Godfrey of Cullompton in the county of Devon which I publish and declare as follows

I give and devise all that my freehold dwelling house consisting of three tenements called Parson’s with the gardens rights members and appurtenances situate near Frogpool in the parish and near the towm of Cullompton in the county of Devon unto my nephew George Churchill of Ottery Saint Mary in the said County cordwainer his heirs and assigns for ever

All that my freehold dwelling house consisting of three tenements called Easter Waterleats together with the gardens orchard and appurtenances thereunto belonging situate in the town of Cullompton aforesaid I give and devise unto my nephew Thomas Churchill of Ottery St Mary aforesaid dairy man his heirs and assigns forever

I give and devise all that my freehold dwelling house consisting of four tenements called Godfrey’s Place with the gardens and appurtenances thereunto belonging also situate in the said town of Cullompton unto my nephew John Churchill of Ottery Saint Mary aforesaid his heirs and assigns forever

I give and devise unto my nephew William Godfrey all those two middle dwelling houses or tenements with the gardens and appurtenances situate in New Street of the town of Cullompton aforesaid occupied by Ebbels and another to hold the same unto the said William Godfrey his executor administrators and assigns

I give and devise unto my niece Ann Urch of the city of Bristol her heirs executors administrators and assigns all that my freehold dwelling houses and leasehold garden with their respective appurtenances situate in The New Cut (leading to Shortlands) in the town of Cullompton aforesaid also all that dwelling house garden and premises situate in New Street aforesaid now occupied by John Ruttley

I give and devise unto Samuel Fowler of Cullompton of aforesaid baker his executors administrators and assigns all that new built dwelling house stable garden and premises with the appurtenances situate in New Street aforesaid now occupied by Henry Broom as tenant to me and lately occupied by William Greenslade

Upon trust to sell and dispose of the same as soon as possible after my decease for the best price that can be obtained for the same either by public auction or private contract and with and out of the monies arising from such sale to pay and discharge all my just debts funeral and testamentary expenses and the legacies hereinafter given as well as all costs and charges incidental to the execution of the trusts of this my Will

And I hereby declare that the receipt or receipts of the said Samuel Fowler his executors administrators or assigns shall be sufficient discharge for any purchaser and that no purchaser or purchases shall be answerable or accountable for the misapplication or nonapplication of such purchase money or any part thereof

I give unto my nephew and niece the said William Godfrey and Ann Urch the sum of five pounds each to be paid them by my executor within one week after my decease

I give unto my friend Henry Voisey of Cullompton stationer the sum of fifteen pounds

I give unto the said Samuel Fowler the sum of fifteen pounds and request his acceptance of the same as a recompense for his trouble

I give unto Mary Ann Veales daughter of William butcher my best watch I wear with the appendages

I give unto the said George Churchill my trunk containing female wearing apparel with the contents

I give all my wearing apparel unto my said nephews to be equally divided between them

All the rest residue and remainder of my real and personal estate monies securities for money goods chattels and effects whatsoever and wheresoever I give devise and bequeath unto the said Samuel Fowler his heirs executors administrators and assigns to and for his absolute use and benefit

And I hereby appoint the said Samuel Fowler executor in trust for fulfilling the purposes of this my Will hereby revoking all former Wills in witness whereof I have hereunto subscribed my hand this twenty second day of March one thousand eight hundred and forty eight

Signed by the said testator as his last Will and Testament in the presence of us present at the same time who in his presence and in the presence of each other have hereunto subscribed our names as attesting witnesses
