Appeared personally Mary Sherwell of Weymouth in the county of Dorset wife of Robert Sherwell of the same place Weslyan minister the executrix named in the last Will and Testament of Elizabeth Harding late Cullompton in the county of Devon widow deceased who died on the fourth day of February 1838
This is the last Will and Testament of me Elizabeth Harding of Cullompton in the county of Devon widow
Whereas under and by virtue of a certain indenture bearing date on or about the tenth day of April which was in the year of our Lord one thousand eight hundred and two under the hands and seals of John Philips and Elizabeth his wife my late deceased father and mother I am impowered to give devise and bequeath the moiety of a certain messuage lands hereditament and premises situate lying and being in the parish of Bampton or Morebath or of both and late in the occupation of [ ] Capron as tenant to me and my sister Joan Hart widow to such of my children as I may bequeath the same
Now I the said Elizabeth Harding pursuant to and by force and virtue and in exercise and execution of the power or authority to me for this purpose given or reserved by the said indenture and of every other power or authority in any wise enabling me in this behalf due by this my last Will and Testament in writing by me signed and published in the presence of and attested by the three credible persons whose names are hereunder written as witnesses thereto direct limit and appoint give devise and bequeath unto my daughter Mary Sherwell the wife of Mr Robert Sherwell her heirs and assigns forever all that the moiety or half part of the said messuage lands hereditaments and premises
All the rest residue and remainder of my real and personal estate whatsoever and wheresoever I give and bequeath the same unto and to the use of the said Mary Sherwell her heirs executors administrators and assigns and I hereby appoint the said Mary Sherwell sole executrix of this my last Will and Testament
In witness whereof I have to this my last Will and Testament set my hand and seal this twenty third day of June in the year of our Lord one thousand eight hundred and thirty two
