Proved in the Archdeaconry Court of Exeter on the 18th of May 1855
Appeared personally Robert Pring of Cullompton in the county of Devon yeoman one of the executors named in the last Will and Testament of Thomas Hitt late of Langford Court in the said parish of Cullompton farmer but living at his death in Clysthydon in the said county who died on the ninth day of December 1854
This is the last Will and Testament of me Thomas Hitt of Langford Court in the parish of Cullompton in the county of Devon farmer
First I give devise and bequeath unto Robert Pring of Poundy Pitt in the said parish of Cullompton farmer and Richard Pring of Langford in the said parish of Cullompton farmer all my life and dead stock corn hay implements in husbandry household goods and furniture money securities for money and every thing that I may die possessed of of what nature the same be or wherever situate in trust as follows requesting them to sell everything that I may die possessed of as soon as convenient after my decease
I give and bequeath unto my niece Mary Clapp daughter of John and Esther Clapp the sum of two hundred pounds which I direct shall be paid her within six months after my decease
I give and bequeath unto my nephew Thomas son of James Trickey of the parish of Rockbeare in the said county farmer the sum of one hundred pounds to be paid him when he attains the age of twenty one years
But in case the said Thomas Trickey should die before he attains the said age of twenty one years and unmarried then I give and bequeath what I have bequeathed unto him to his sister Emma Trickey my niece to be paid her when she attains the age of twenty one years
And it is my will that the said one hundred pounds shall be put out by my trustees at interest on good security until my said nephew Thomas Trickey attains the said age of twenty one years and in case of his death and dying unmarried before he attains the said age of twenty one years then the amount to remain out at interest until my said niece Emma Trickey attains her said age of twenty one years
And as to all the rest residue and remainder of my effects after payment of my just debts funeral expenses and the expense of proving this my Will I give and bequeath the same unto my sister Elizabeth wife of the said Robert Pring my said niece Mary Clapp and my nephew John Clapp share and share alike
I give and bequeath unto each of my bearers which shall be six in number the sum of one pound a hat band and a pair of gloves
And lastly I do hereby nominate constitute and appoint them the said Robert Pring and Richard Pring executors in trust of this my last Will and Testament and my will is and I do hereby direct that
my said executors and trustees shall each of them be answerable for his act and receipts only and not the one of them for the other of them and that they shall not be answerable for any loss or miscarriage by any security or securities that may happen in my estate and also that they shall retain all their cost charges damages and expenses out of the estate and effects in them respectively vested in and by this my Will and the trusts therein contained
In witness whereof I the said Thomas Hitt have to this my last Will and Testament subscribed my hand the sixteenth day of January one thousand eight hundred and fifty four
