In the name of God Amen I Jonas Kendall of Collompton in the countie of Devon gentleman being weake of bodie but perfect of memorie thanks be to God doe make this my last Will and Testament in manner and form following
First I give and bequeath my soule into the hands of Almightie God my Maker and Redeemer hoping to be saved by the meritts and satisfaction of Jesus Christ my Redeemer and my bodie unto decent buriall
Item I give and bequeath unto the poore of the parish of Collompton aforesaid ten shilings to be bestowed in bread
Item whereas I the said Jonas Kendall am now possessed of the moyetie and halfendeal of two dwelling houses with the appurtenances in Collompton aforesaid the one of them now in the tenure of William Bidwell and the other in the tenure of John Walter for and during the terme of four score and nyneteen years if I the said Jonas and Jonas Kendall and Mary Kendall my sonne and daughter or either of us soe long live under the yearely rent of fifty shillings by the grant and demise of Sir John Strangeways knight by deed bearing date the six and twentieth day of March one thousand six hundred fiftie seaven as by the same deed appeareth
And whereas I the said Jonas Kendall doe stand likewise possessed of and in the twelveth part of the said two dwelling houses with the appurtenances and of two little meadowes called Wormerwell and in the twelveth part of three other closes called the higher and western Scabingdons and in the twelveth part of two other closes called Shortlands and of three other closes called Perrywoods and of and in the twelveth part of one other close called Dodpoole and of the twelveth part of one other little meadowel called the meadow by Culme Bridge situate in Collompton aforesaid for the like terme of four score and nyneteene years if I the said Jonas Kendall Mary my daughter and Julian Turner daughter of John Turner deceased or either of us so long live under the yearely rent of twelve pence all which last mentioned premises I hold by the demise and brand of Francis Courtney esquire Sir Simon Leach knight and others by their deed and grant made bearing date the twentieth day of January in the tenth year of the reigne of the late King Charles over England as by the said deed appeareth
And whereas by a certaine contract and agreement in writing bearing date the twentieth day of May one thousand six hundred fiftie seaven had and made by William Windham esquire of the one part and mee the said Jonas Kendall of the other part the said William Windham hath agreed to grant unto me an estate by lease of and in five parts in twelve parts to be decided of the aforesaid three closes called the Higher western Scabingdons and of the said two closes called Wormswell and Shortlands and two little meadows thereunto and of two closes called Bowriwoods for four score and nineteen years if I the said Jonas Kendall and Jonas Kendall the younger and Mary Kendall my sonne and daughter or either of us soo long live under such rents reservations and other agreements therein contained and by the same contract agreement under the hand of the said William Windham appeareth
And whereas the said Sir John Strangewaies by one other deed bearing date the first day of December in the yeare of our Lord God one thousand six hundred and fiftie six have demised and granted unto mee the said Jonas Kendall all that his moyetie or halfendeale of the messuage and dwelling house and dye house parcel of a tenement called Harlowend Place and also the moietie of one close called Crosse close and the moyetie halfendeal of one other close called Greate Clampitt situate in Collompton aforesaid for and during the like terme of four score and nynteene yeares if Jonas Kendall the younger and Mary Kendall my sonne and daughter and Jonas Wall son of Edward Wall or either of them so long live unto the yearely rent of one shilling and by the same deed appeareth
And whereas the said William Windham esquire by one other deed bearing date the ninth day of February one thousand six hundred fiftie six hath demised and granted unto mee the said Jonas Kendall all those his six parts in twelve parts to be decided of the aforesaid messuage dwelling house dye house with the appurtenances in the possession of John Bale dyer and of and in the aforesaid close called Crosse and the Great Clampitts situate in Collompton aforesaid for four score and nineteen yeares if the said Jonas and Mary my sonne and daughter and Jonas Wall or either of them soe long live under the yearely rent and rents therein referred on by the same deed appeareth
Now I the said Jonas Kendall doe hereby devise and bequeath unto John Saffyn of Collompton in the countie of Devon Gentlemen John Kingdome of Colrugg in the countie aforesaid gentlemen and John Prowse of Collompton aforesaid gentlemen all the aforesaid messuages dwelling house dye house closes and parcells of land and all other the premises mentioned or intended to be demised in or by the said severall recited deeds and contract and every of them and all my estate and estates right title part and parts termes of yeares and demaund of and in the forme and every part thereof to have and to hold the same and every part thereof to them the said John Saffin John Kingdome and John Prowse their executors and assignses from and after the day of my death for and during the terme of five years thence next ensuing fullie to be compleate and ended
Upon trust and confidence nevertheless that they the said John Saffin John Kingdome and John Prowse and his survivours and survivour of them and the executors and assignes of such survivour shall sett and lett the said premises during the said terme or any part thereof to such person and persons and for such yearely rent or other considerations as they in their discretions self think fit and out of and with the cleare rent issues and profitts thereof shall as soone as may be conveniently after my decease satisfy and discharge such debts as shall be owing by me att the tyme of my death and for the fine of three score pounds to be become due to the said Master Windham according to the said contract and such summe and summes of money and legacies as I shall hereafter give and bequeath by this my last Will and Testamt soe far as the said clear yearely rents and profitts thereof will extend unto deducting out of the same all such rates taxes payments high rents reparations and other costs and charges and expenses whatsoever they or either them shall expend or be compelled to beare by reason of or in respect of these presents or by reason of the trust aforesaid or wherewith the said premises or some part thereof shall be chargeable and after such deduction and allowments by them made as aforesaid and after such debts summe and summes of money satisfied and paid as aforesaid that then the said trustees and the survivours and survivour of them and the executors and assignes of such survivour shall surrender and yield upp all and singular the said messuages and premises unto my executor hereafter named or to his executors or assignes together with an account of their paid disbursements in writing if my executor or his assignes shall require the same and all such summe and summes of money as shall be resting in their hands over and above such disbursements as aforesaid
And I doe further desire and appoynt that the lease agreement above mentioned and intended to be made unto mee by the said William Windham esquire shall be taken in the names of my said trustees some or one of them if they thinke fit and the issues and profits thereof to be by them imployed for the intents and purposes aforesaid during the said terme and afterwards the same and all their right and interest to be conveyed over unto my said executor or his assignes and my will and meaning is that my said executor immediately after my decease shall give his own security by obligation in the summe of one hundred pounds lawfull money of England to permit the said trustees and everie of them to have and enjoy all the promises for and during the terme aforesaid for the uses intents and purposes aforesaid without the lett or interruption of my executor or his executors or assignes
Item I give and bequeath until Thomas Voisey sonne of George Voisey five shillings
Item I give and bequeath unto Jonas Wall son of Julian Wall widdowe the summe of fortie shillings to be paid in six months after such tyme as my executor hereafter named shall exchange the life of the said Jonas in the estate which are lately purchased of Sir John Strangewaies knight and William Windham esquire as aforesaid
Item I give unto Elizabeth and Mary Wall daughters of the said Julian Wall two shillings and sixpence apiece
Item I give and bequeath unto Mary Kendall my daughter tenn pounds lawfull monie of England to be paid unto her in two years next after my decease and to be paid unto her by quarterly payments the first payment to be made and paid within one quarter of a yeare next after my decease
Also I give and bequeath unto the said Mary Kendall my daughter the summe of fifteen pounds like lawfull money to be paid unto her att the end of three yeares next after my decease
All the rest of my goods chattells not before given and bequeathed my debts and legacies being paid and my funeral expenses discharged I give and bequeath unto Jonas Kendall my sonne whom I doe make my whole and sole executor of this my last Will and Testament
In witness whereof I the said Jonas Kendall have hereunto sett my hand and seale the fifteenth day of March in the year of our Lord God one thousand six hundred fiftie and seven

Memorandum
It is my further will and meaning that if my said debts and legacies shall be satisfyed and paid within the terme of five yeares after my death that then my said trustees theire executors and assigns shall grant and assigne over all the aforesaid messuages and premises and all their rights and interest therein then to come unto my said executor or to his executors or assignes

This Will was proved at London the sixteenth day of the month of September in the yeare of our Lord God one thousand six hundred fiftie and nyne before the judge for Probate of Wills and granting Administrations lawfully authorized by the oath of Jonas Kendall the naturall and lawfull sonne and sole and only executor named in the last Will and Testament of the deceased to whom administration of all and singular the goods chattells and debts of the said deceased was granted and committed he being first legally sworne by virtue of a commission duly and faithfully to administer the same
