In the name of God Amen I John Lane of Colompton in the countie of Devon yeoman being in good and perfect health and memory (praised be God) doe make and declare this my last Will and Testament in manner and forme following (vizt)

First I bequeath my soule into the hands of Almightie God my only Saviour and Redeemer hoping through the merritts of Jesus Christ to obtayne remission of all my sinnes and life eternall and my body I bequeath to Christian buriall

Item I give and devise unto my coson Richard Lane the sonne of my brother William Lane deceased all my lands and tements of inheritance lyeing in Peyhembury Coppit and Morden in the sayd countie of Devon which I lately purchased of John Pygott, John Westlake and Sir Walter Smith knight or either of them with all the rents presents and hereditements thereof or thereunto respectively belonging to have and to hould the same landes tenements and premises unto him the said Richard Lane and his heires forever

Uppon trust and confidence nevertheless and to the intent and purpose that he the sayd Richard Lane shall in convenient tyme or as soone as maybe after my decease by advice of someone learned in the lawe by good and perfect assurance or conveyance settle assure and convey all and singular the said landes tenements and premises to the uses intents and purposes hereafter in this my last will limmitted and declared that is to say to the use of him the said Richard Lane and his assignes untill John Lane my godsonne and sonne of my said coson Richard Lane shall attayne to the full age of one and twenty yeares and then to the use and behoofe of the said John Lane my godsonne (sonne of my said coson Richard Lane) and of the heires males of his body lawfully begotten

And for default of such yssue to the to the use and behoofe of the said Richard Lane my coson for terme of his life

And in default of such yssue male of the body of the said John Lane the sonne then to the use and behoof of the heires males of the bodie of the said Richard Lane and for default of such yssue then the use and behoofe of the heires males of the body of the said Richard Lane

And for default of such yssue then to the use and behoofe of James Lane brother of the said Richard and of the heires males of his body lawfully begotten

And for default of such yssue then to the use of John Lane of Broadhembury (sonne of my brother Richard Lane deceased) and of the heires males of his body lawfully begotten

And for default of such yssue then to the use and behoof of the heires females of the body of my said coson Richard Lane (sonne of my said brother William Lane) lawfully begotten and to be begotten

And for default of such yssue then to the use and behoofe of the right heires of me the said John Lane forever

All the sayd lands and tenements to be charged nevertheless with the payment of one annuity or yearly rent of tenn poundes unto the said James Lane and his assignes dureing the terme of tenn yeares next after my decease yf the said James Lane soe longe shall happen to lyve and the same to be payed quarterly at the fouere most usuall feasts of the yeare by even portions nevertheless with power of distresse for non payment thereof at the feast aforesaid

Item my will and meaning further is and I doe hereby declare and appoint that my said coson James Lane shall nevertheless have and enjoye all they said lands and premises called Morden and all my fouere quarter part thereof to him and his assigns untill my said godson John Lane son of my said coson Richard Lane shall attaine unto the age of one and twentie yeares yf he the said James Lane shall soe long happen to live paying two shillings yearly rent for the same to my said coson Richard Lane his executors and assigns at the fouere most usual feasts of the year by even portions soe longe as the said James Lane or his assignes shall soe hould and enjoye the same

And after my said coson John Lane (sonne of my said coson Richard Lane) shall attaine to his full age of one and twentie yeares my will and meaning is that my said godsonne John Lane shall have and enjoy all the said premises called Morden and all my severall leases and whole estate therein

But yf the said John Lane happen to dye before his age of one and twentie years yet nevertheless the said James Lane shall have and enjoye all the sayd premises called Morden until the fouer and twentieth day of June Anno Dm one thousand six hundred fyftie six being the tyme when the said John Lane my coson should accomplish the age of one and twentie yeares yf the said James lyve so long

And afterwards I doe bequeath limitt and appoint all my said leases and termes then to come of and in the premises called Morden or any part thereof to such person and psons and their heires respectively to whome the quarter part thereof of inheritance which I bought off the said Sir Walter Smith is before limitted and appointed by this my will

Item I give and devise unto my said coson James Lane all my leases estate and interests of and in the lands and tenements in Broadhembury aforesaid called Shabrook and Bowood which I hould of Sir Thomas Drewe knight

Item I give and bequeath unto my coson Anne Mannyng the wife of Xpher Mannyng of Colompton fyftie poundes But my will is that the same shall remain in the handes of my executor hereafter named of this my last Will until after the death of the said Christopher Manning and then to be payed unto her or her assignes

And my said executor dureing the joynte lyves of the said Christopher and Anne shall yearly paye unto the proper hands of the sayd Anne Mannyng for her owne proper use the yearly summe of fouere pounds at the fouere most usuall feasts of the yeare by even portions the first portion thereof to beginn at the next of the sayd feasts which shall first happen after my decease or otherwise the said yearly summe of fouere pounds to be produced and defeated by my said executor of this my will for such use and benefitt of the sayd Anne Mannyng and in such manner as shall by writing under her hand and seale shall limitt or appoint

And yf the sayd Anne Manny shall happen to dye in the lifetyme of the said Christopher Mannynge then my will is that the said fiftie pounds be equally divided and payed among all the children of the sayd Anne and Xpher that shall be liveing at the death of the said Anne Manning but to remaine in the handes of my said executor and by him to be ordered and disposed for the best benefit and interest of the said portions until they said children and either of them shall respectively attaine to the age of one and twentie yeares

And my said executor after my decease shall give his bond to my said coson Richard Lame for the true payment of the said fyftie poundes and yearly summe of fouere poundes in manner aforesaid

Item I doe charge and appoint my executor hereafter named to satisfie and paye all my debts which I shall owe at the tyme of my death out of and with my personall estate which I shall devise or leave to him by this my Will and my said coson Richard Lane [ ] lands bounde for me to be freed and discharged thereof

Item I give and bequeath tenn poundes to be equally divided among all the children of my brother in law James Searle of Talaton deceased which shall be living at the tyme of my decease to be payed within one yeare after my death

Item I give to Elizabeth and Anne Bevercoombe daughters of my brother in lawe John Bevercoombe fortie shillings apiece to be payed as aforesayd

Item I give to my coson Johan Hill nowe wife of Robert Miller fortie shillings and to her brother Richard Hill fortie shillings to be payed as aforesayd

Item I give to my said coson John Lane of Broadhembury sonne of my said brother Richard Lane five poundes to be payed as aforesayd and to Anne and Mollie the two daughters of the said Richard Lane fortie shillings apiece to be payed as aforesayd

Item I give to my coson Mary Lane now wife of my coson Richard Lane fortie shillings

Item I give to Richard Rutly Thomasyn Manly and Bethsheba Symons nowe servants to my coson Richard Lane fortie shillings apiece to be payed within one yeare after my death

All the rest of my goods and chattles bills bondes and ready money not formerly given and bequeathed I doe by this my last Will give and bequeath unto my coson James Lane (sonne of my said brother William Lane) whome I doe make and ordaine to be sole and whole executor of this my last Will and Testament and I hereby revoke and renounce all former Wills

In witness thereof I have hereunto sett my hand and seale the fyfe and twentieth day of October in the thirteenth yeare of the raigne of our sovereign Lord Charles now king of England or Anno Dm 1637 the marke of John Lane

Memorandum that upon the twentie fyfth day of October one thousand six hundred thirtie seaven being the date of these presents the said John Lane did acknowledge and declare this writing contayned in fouere sheets of [ ] together to be his last Will and Testament which was first distinctly read unto him and thereupon he the said John Lane did sett his hande and seale to every of the said leaves or sheetes and another seale at the topp thereof in the presence of us John Cole John Taylor Walter Gibbings William Sumpter
