In the name of God Amen

The three and twentieth day of July one thousand six hundred forty and fouer I Roger Liswell of Collompton in the county of Devon yeoman being of perfect mind and memory thankes bee given to Almighty God doe make this my last Will and Testament in manner and forme followinge

Imprimis I bequeath my soule to Allmighty God my maker and Jesus Christ my Redeemer and my body to christian buriall

Item I I give towards the repayring of the parish church of Collompton one shilling

Item I give to the poore of the parish of Collompton twenty shillings to bee distributed at the time of my buriall by my overseers

Item I give and bequeath unto Damery Clearke my daughter six poundes of lawfull money

Item I give and bequeath to Johane Hill my daughter twenty poundes of lawful money

Item I give and bequeath to Willmott Baker my daughter twenty shillings of lawfull money

Item I give and bequeath to Anne Webber my daughter twenty shillings of lawfull money

Item I give and bequeath to John Liswell my sonne one shilling of lawful money

Item I give and bequeath to John Liswell of Collompton blacksmith ten shillings of lawfull money

Item I give and bequeath to Roger Webber my godsonne tenn shillings of lawful money

Item I give and bequeath to Martin Liswell my grandchild forty shillings of lawfull money

Item my will is that all the legacies formerly given and bequeathed shall bee payd by my executrix here after named within the space of one yeare next after my decease And if my goods will not extend for [ ] to pay the legacyess aforesayd then everyone of them to [ ] of their legacies a portion and portion like

Item I give and bequeath to Johane Clearke now wyfe of John Serle the daughter of John Clearke [ ] my sonne in lawe one burgage messuage or tenement within the borrowe of Bradninch now in the tenure or occupation of one Thomas [ ] to have hould and injoy the aforesayd burgage messuage or tenement unto the sayd Johane Clearke and her heires male forever

And further my will is if the sayd Johane Clearke dye having noe heirs male then the sayd burgage messuage or tenement wholy to remayne to William Clearke sonne of the aforesayd John Clearke and to his heires forever further my will is if William Clearke dye having noe heir male then the sayd burgage messuage or tenement to wholly remayne to to Edward Clearke sonne of the aforesayd John Clearke and to his heirs male forever further my will is if Edward Clearke dye having noe heirs male then the sayd burgage messuage or tenement wholly to remayne againe to the right heirs of me the sayd Roger Liswell forever

And for the confirmation thereof my will is that the wrytinges and evidences concerning the same shall be delivered by my executrix into the handes of my overseers hereafter named or some of them and to remayne to the survivors or survivor of them to bee kept in trust for the most quiet injoying of the premises as aforesayd is expressed

And wheras Edith my now wyfe before marryage did enter into some severall bonds bearing date the eighth day of May one thousand six hundred thirty and nyne unto me Roger Lizwell my executors administrators and assigns for the payment of forty pounds of lawfull money of England by tenn pounds yearly next after my decease out of the tenement which she the sayd Edith is to enjoy according to the custome of the mannor of Allerpeverell if she shall long live now by certaine articles of covenants and agreements [ ] appeareth

Now my will is that the sayd Edith shall pay but twenty pounds of the aforesayd summe as followeth

Item I give and bequeath to Grace Hill the daughter of Johane Hill my daughter five pounds of lawfull money to be payd att one year end next after the day of my buryall by my wyfe Edith out of the sayd summe of twenty pounds being the first payment

Item I give and bequeath to Alice Clearke the daughter of Damery Clearke my daughter five pounds of lawfull money to be payd by Edith my wyfe in the second yeare next after my decease

Item I give and bequeath to Elizabeth Baker the daughter of Wilmott Baker my daughter five pounds of lawful money to be payd by Edith my wyfe in the third yeare next after my decease

Item I give and bequeath to Roger Liswell the sonne of John Liswell my sonne five pounds of lawfull money to bee payd by Edith my wyfe in the fourth year after my decease to my overseers to bee putt by them to the best use and benefit for the sayd Roger until hee shall accomplish the full age of one and twenty yeares but if the sayd Roger Liswell doe happen to dye before he accomplish the age of one and twenty years that then the sayd five pounds and the bennefitt thereof to remayne to my sayd executrix

Item I give and bequeath unto Edith my wyfe my bedstead and bed wholly performed which I usually lye in and the truckle bedstead under the same the bed boulster blanketts and coverlett and not the worst

Item I give and bequeath to Edith my wyfe thirteen pounds in goodes such as shall to her best likinge to be adjudged by two indifferent men

Item I give unto my said wyfe all such goods as she brought with her the properties thereof being not altered

Item I give and bequeath unto my sayd wyfe two silver spoons one of the best one warming pan one try or trowe and half of my timber vessells vates hogsids barrells and such like and all my furnace in the kitchinge or bakehouse and one [ ] and one payre of [ ] and further my will is that the [ ] presse tableboard and sealinge in the parlour and alsoe the tableboard [ ] cubbord and sydeboard in the hall shall remayne in the house during the widowhood of Edith my now wyfe

And further my will is that if my sonne John Liswell doe over live the sayd Edith and that the tenement doe come into the handes of the sayd John hee shewing himself a carefull husband that then the sayd implements aforesayd to remayne to the sayd John Liswell but if hee continued in his lewd [ ] my will is that the sayd implements shall remayne to my executrix

And whereas I Roger Liswell have a grante of Sir John Poole baronet of a house estate orchard and garden called [ ] in the mannor of Allerpeverell in Collompton aforesayd for fouerscore and nyneteene yeares if Rogen Liswell and Lydia Liswell soe long happen to live being in reversion my will is that if my wyfe Edith have a child by mee then I give and bequeath the sayd house estate orchard and garden unto the sayd child for and during all the residue and remaynder of the aforesayd terme which shall bee to come and unexpired immediately after my decease together with all the wrytings and evidences concerning the same

But if my my wyfe Edith have noe child then I give and bequeath the aforesayd house orchard and garden unto the aforesayd Roger Liswell for and during all the rest and remaynder of the aforesayd term of the sayd [ ] granted by the sayd Sir John Poole as and in the sayd grante more att large appeareth or the remainder of the sayd term to be for the good and bennefitt of the sayd Lydia my sister

And further my will is that my writinges concening the same shall be delivered by my executrix immediately after my decease unto the sayd Roger Liswell

Item all the residue of my goodes and chattels not formerly given nor bequeathed my debts and legacies payd and funeral expenses discharged I give and bequeath unto Thomasin Baker the daughter of John Baker my sonne in law whom I make my whole and sole executrix

Item I ordaine appoint and desire my brother in law John Way my sonne in lawe Robert Hill my sonne in law John Baker and my brother in law Robert [ ] to bee my overseers and to see this my last Will and Testament justly performed hoping they will use their best endeavors therein and for their paynes I give unto each and every of them two shillings of lawfull money

In witness whereof I have hereunto put my hand and seal proven the day and yeare above written Roger Liswell
