In the name of God Amen the thirtie day of March anno domini 1575 and in the seaventeneth yere of the reigne of our Soveraigne Lady Elizabeth by the grace of God Queen of England France and Ireland defender of the faith etc. I Thomas Markes of Colompton in the countie of Devon clothier do make and ordeyne this my last Will and Testament in manner and forme folowinge

First I bequeath my soule to almightie God and my body to be buried in the churche yarde of Colompton

Item I will and bequeath that seaven of my children together with one child which Mary my wyfe goeth with being eight in number shall have the summe of fouerscore pounds of lawfull money of England devided amongst them in manner and forme following

First that John my eldest sonne shall have when he shall aspire and growe to the full age of one and twentie yeres the summe of tenn pounds

Item I will and bequeath that my sonne Thomas the elder shall have at his said full age of twentie and one yeres the summe of six pounds thirtene shillings and foure pence

Item I will and bequeathed that Henry Markes my sonne shall have likewise at his said full age of twentie and one yeres the summe of tenn pounds

Item I will and bequeath that my younger sonne Thomas shall have at his said full age of twentie and one yeres the summe of tenn pounds

Item I will and bequeath that Alice my daughter shall have at the day of her marriage or when she shall come to the full age of one and twentie yeres the summe of six pounds thirtene shillings and foure pence

Item I will and bequeath that my daughter Thomazine shall have at the day of her marriage or when she shall come to the full age of one and twentie yeres the summe of [ ] pounds thirtene shillings and four pence

Item I will and bequeath that my daughter Thomasine shall have at the day of her marriage or when she shall come to the full age of one and twentie yeres the summe of thirtene pounds six shillings and eight pence

Item I will and bequeath that Helen my daughter shall have at the day of her marriage or when she shall come to the full age of one and twentie yeres the summe of thirtene pounds six shillings and eight pence

Item I will and bequeath that the child now with Mary my wife goeth such childe shall have if it be a manchilde when it cometh to the full age of one and twentie yeres the summe of tenn pounds if it be a woman then at the day of her marriage or one and twentie yeres tenn pounds

Provided always and my will is that if so be any of my said children happen to die before they shall come to the said full age of one and twentie yeres or the day of her marriage that any of the said summes so due to him or them so dying or deade the said summes shall then be delivered to my overseer or overseers hereunder named and he or they to see the said summe or summes equally to be divided amongst them my said children livinge when they shall come to the said full age and tyme above expressed

And if all my said children shall happen to die before they shall come to the full age and tyme above expressed that then my will is that my executrix hereunder named shall enjoye and have to her only use all the said partes and portions and any portions to any of my said children so before bequeathed

Item I give and bequeath to my sonne John one payre of kersey lomes with [ ] and all things apperteyninge to the said payre of lomes

Item further I give and bequeath to Thomas Markes the elder my second sonne and to his assignes the use and occupation of one tenement with the appurtenances lieing in the parishe of Colompton now in the teanure and occupation of one Helen Blackmore wydow he the saide Thomas and his assignes to have and to hold the same tenement with the appurtenances during my whole estate and terme which I have or ought to have therein

Yealding and payinge therefore yerely unto my said sonne John and to his heires and assignes duringe the said terme when the said tenement shall happen to fall and come to him or them accordinge to this my Will the summe of twentie six shillings and eight pence yerely if it be lawfully asked at foure feasts or termes of the yere most usually by even or equal portions or within one month next and ymmediately after any of the said most usual feasts and termes on and above the rent due unto the lord of the mannor of Colompton aforesaid for the yerely rent of the same

Provided always and my will is that if my sonne Thomas the elder or his assignes do or shall make defaulte in payment of the said summe of twentie six shillings and eight pence yerely being so lawfully asked at any of the said feast as aforesaid or within one month after the said usual feast as aforesaid that then I give and bequeath unto my said sonne John all my right interest title and terme of yeres which I the said Thomas have or of right ought to have of and in the premises and any parte and parcell thereof and my said sonne Thomas the elder and his assignes to take no benefit of this my gifte and bequest to the tenement aforesaid or to any parte or parcell thereof and thereof he and his assignes to be excluded for ever any thinge above expressed to the contrary not withstandinge

Item I give and bequeath to Henry my sonne the use and occupation of one tenement lieing and beinge in the parishe of Colompton in the countie aforesaid wherein Thomas [ ] als Parker now inhabiteth he the said Henry and his assignes to have and to hold the same tenement with the appurtenances during my whole estate and terme which I houlde or ought to have herein

Yealding and payinge therefore yerely unto my said sonne John and to his heires and assignes duringe the said terme when the said tenement shall happen to fall and come to him or them accordinge to this my Will the summe of three shillings yerely if it be lawfully asked at foure feasts or termes of the yere most usually by even or equall portions or within one month next and ymmediately after any of the said most usuall feasts and termes over and above the rent due unto the lord of the mannor of Colompton aforesaid for the yerely rent of the same

Provided always and my will is that my said sonne Henry or his assigns do or shall make defaulte in payment of the said summe of the three shillings yerely beinge lawfully asked at any of the said feasts as aforesaid or within one month after the said usuall feast as aforesaid that then I give and bequeath unto my said sonne John all my right interest title and terme of yeres which I the said

Thomas have or of right ought to have of and in the premises and any parte and parcell thereof and my said sonne Henry and his assigns to take no benefitt of this my gifte and bequest to the tenement aforesaid or to any parte or parcell thereof and thereof he and his assignes to be excluded forever any thinge above expressed to the contrary not withstanding

Item I give and bequeath to Thomas Markes the younger my sonne and to his assignes the use and occupation of one tenement with the appurtenances lieinge in the parishe of Colompton aforesaid now in the tenure of one Thomasyn Salter he the said Thomas the younger and his assignes to have and to holde the same tenement with the appurtenances duringe my whole estate interest and term which I have or ought to have therein

Yealding and payinge therefore yerely unto my said sonne John and to his heires and assignes duringe the said terme when the said tenement shall happen to fall and come to him or them accordinge to this my Will the summe of seaven shillings yerely yf it happen to be lawfully asked at foure feasts or termes of the yere most usually by even portions or within one month next and ymmediately after any of the said most usuall feasts and termes on and above the rent due unto the lord of the mannor of Colompton aforesaid for the yerely rent of the same

Provided alwayes and my will is that if my said sonne Thomas the younger or his assignes do or shall make defaulte in payment of the said summe of seaven shillings yerely being so lawfully asked at any of the said feasts as aforesaid or within one month after the said usuall feast as aforesaid that then I give and bequeath unto my said sonne John all my right interest title and terme of yeres which I the said Thomas have or of right ought to have of and in the premises and any parte and pcell thereof and my said sonne Thomas the younger and his assignes to take no benefitt of this my gifte and bequest to the tenement aforesaid or to any part or parcell thereof and thereof he and his assignes to be excluded forever any thinge above expressed the contrary notwithstanding

Item further my will is that as longe as Mary my said wyfe shall maynteyne and kepe my said children with her that then my will is that the said Mary shall have the legacy above expressed in her custody or kepinge so that she the said Mary within one month next after my death do become and enter into bond in the summe of two hundred marks unto my overseers here under named for the true payment of the legacy by me Thomas Markes above said given and bequeathed

And further my will is that if any of my said children be put to masters at the discretion of Mary my wyfe or my overseers or any of them that then forth which any of the said children so put to masters shall forthwith have suche portion of money which my said children or any of them as within my Will and Testament is bequeathed and given so as he or they that shall have the said children shall enter into bonde in doble the said summe with sufficient securities unto my overseers hereunder named for the true payment thereof when they or any of them shall accomplish they said full age and tyme above expressed

Item my will is that my legacies debtes and funerall paied and discharged Mary my wyfe to have all the rest of my goods and chattells not given and bequeathed whome I make my sole executrix

Item I ordeine and make my overseers to see this my last Will and Testament performed Mr John Thomas, Thomas [Myny..] and Symon Kellewaye

In witness whereof we the parties whose names being here under subscribed have entereth aimyeably sett our handes the day and yere above written William Jenninge Thomas [Mynysoe] Symon Kellawaye
