Proved in the Archdeaconry Court of Exeter the 23rd of August 1826
In the goods of John Martin late of Cullompton in the county of Devon gentleman deceased.
Appeared personally Philip Martin of Cullompton in the county of Devon yeoman the sole executor named in the Will of the said John Martin his late brother who died on the 22nd day of August 1826
This is the last Will and Testament of me John Martin of Cullompton in in the county of Devon gentleman made this second day of April in the year of our Lord one thousand eight hundred and twenty three.
I give and bequeath unto my brother Henry Martin the sum of five hundred pounds at the expiration of twelve calendar months after my decease
And all the rest residue and remainder of my monies securities for money and all other my estate and effects of what nature or kind soever or wheresoever situate (after paying all my just debts funeral and testamentary expenses) I give and bequeath unto my brother Philip Martin whom I hereby make my whole and sole executor of this my last Will and Testament
And I further will and declare that should my brother Henry Martin die before me that the said sum of five hundred pounds given to my said brother as aforesaid shall be equally divided amongst his children (if any) share and share alike and if no child or children the said sum of five hundred pounds shall be retained by and for the sole use of my executor
And should my said brother Philip Martin die before me I give and bequeath all the rest residue and remainder of my estate and effects to his children (if any) share and share a like
And I hereby revoke all former Wills and Wills by me at any time made and ratify and confirm this alone to be my only true last Will and Testament
In witness whereof I said John Martin the testator have to this my last Will and Testament set my hand and seal the day and year first above written John Martin
Signed sealed published and declared by the said John Martin the testator as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses hereto
