Proved in the Principal Registry of the Lord Bishop of Exeter 12th day of May 1843

Appeared personally Charles Salter of Cullompton in the county of Devon yeoman and John Sharland of Bradninch in the said county gentleman the executors named in the last Will and Testament of Juliana Mondy late of Cullompton aforesaid widow deceased who died on the 20th day of April 1843

This is the last Will and Testament of me Juliana Mondy of Cullompton in the county of Devon widow which I publish and declare as follows

I give and devise unto Charles Salter of Cullompton in the county of Devon yeoman and John Sharland of Bradninch in the said county gentleman their executors administrators and assigns all my good chattels money and securities for money debts and all other my personal estate and effects whatsoever and wheresoever which I shall die possessed of upon the trust hereinafter expressed (that is to say)

Upon trust that they the said Charles Salter and John Sharland and the survivor of them do and shall with all convenient speed after my decease sell and dispose of all my goods chattels and effects (except as hereinafter given) and collect and get in or rent and debts and money due to me on mortgage bond note or any other kind of security and I declare that the said Charles Salter and John Sharland and the survivor of them shall stand possessed of all the money to be produced from such sale of my personal estate and of and in the monies and securities for money to which I shall be entitled at the time of my decease and of and in the rents issues and profits interest and produce thereof respectively until the same shall be disposed of called in and converted into money

Upon trust that they the said Charles Salter and John Sharland and the survivor of them do and shall out of such monies vested in them as aforesaid at the expiration of three months next after my decease or as near thereto as possible (subject nevertheless to all my just debts funeral and testamentary expenses) pay unto my son John Mondy the sum of nine pounds and unto his wife Elizabeth the son of one pound

Also unto all my grandchildren living at the time of my death the sum of ten shillings each

I give unto my daughter Juliana Harris the sum of fifty five pounds also my buffet china and glass and my clock

I give my daughter Ann Rowe the sum of sixty pounds also my parlour glass and grandmothers likeness tea caddy and bible

I give unto Elizabeth Williams my daughter the sum of sixty pounds also my silver cream jug and silver spoon belonging thereto and my chest of drawers

Unto Hannah Stark my daughter I give the sum of sixty five and also the remaining part of my silver spoons which said several legacies I direct my said trustees to pay within three months next after my decease or as soon after as possible

And I hereby declare that the legacies so given to my said daughters to be for each of their sole and separate use separate and apart from each of their husbands respectively and not to be liable to either of their husbands debts controls or engagements and I also declare that the receipt and receipts of my said daughters alone shall be a good discharge and discharges for all such sum and sums of money as shall be respectively paid them by my said trustees

And I hereby further declare that the receipt and receipts of my said trustees or the survivor of them or any money payable under this my Will shall effectually discharge the person or persons paying the same from being answerable or accountable for the misapplication or non application thereof

Provided always and I hereby declare that if either of my said daughters shall happen to die before her legacy shall become payable then I direct my said trustees to pay and divide the legacy of either of my said daughters so dying unto and equally amongst all her surviving children

And whereas the sum of two hundred pounds was secured to me under my marriage settlement during my life and afterwards to go to my children now I hereby direct my said trustees to fulfil the term of such deed of settlement and pay and divide the said sum of two hundred pounds equally between all my children living at the time of my decease

I give unto my said son John my best mahogany table and his father’s watch and appendages

I give unto my granddaughter Mary Ann Harris my work box

All my wearing apparel I give unto all my said daughters to be equally divided between them

And it is my will that if any deficiency shall appear in my property to fulfil the purposes of this my Will then I direct all the legatees (except my said son’s wife and my grandchildren) to bear a proportional abatement on their legacies to meet the same but if it happen a surplus shall eventually remain in the hands of my said trustees then I direct such surplus to be equally divided between my said four daughters share and share alike

And I appoint the said Charles Salter and John Sharland joint executors in trust for fulfilling the purposes of this my Will hereby revoking all other Wills In witness whereof I have hereunto set my hand this twenty fifth day of October one thousand eight hundred and forty one
