Will of Samuel Morgan, late of Cullompton, Dissenting Minister

I Samuel Morgan of the parish of Cullumpton in the county of Devon dissenting minister being of health of body and of sound and disposing mind and memory but considering the certainty of death and the uncertainty of the time when do make publish and declare this my last Will and Testament in manner and form following

I commend myself to Almighty God looking for the general resurrection in the last day and expecting a future life through Jesus Christ in a firm belief of whose religion as it is revealed and published in the New Testament I hope by God’s assistance to live and die

I constitute and appoint my worthy and much esteemed friend Mr William Nation of the city of Exeter merchant a trustee in the room of the Revd John Foyle of the city of Bath clerk deceased with full power to act in consent with my highly esteemed friend the Revd Pears Follard of Bishop’s Hull in the county of Somerset clerk according to the tenour and the true intent and meaning of a deed in writing made prior to my own marriage with my dearly beloved wife Elizabeth Morgan deceased

I give devise and bequeath unto the said Pears Follard and William Nation and the survivor of them all my personal estate whatsoever and wheresoever not hereby or otherwise by me disposed of to hold to them or the survivor of them on the following trusts (that is to say)

In trust for the use and benefit of my dear children Bennett Stevenson Morgan and Ann Lloyd Morgan as tenants in common and not as joint tenants the rents and profits of the whole to be applied according to the discretion of the aforesaid trustees for their maintenance education and settlement in life and to have share and share alike when they arrive at the age of twenty one years

And if either or both of them should marry before they arrive at the age of twenty one years with the consent and approbation of their guardians and should die before they are of that age leaving issue then his or her share shall go and be paid to the child or children of that marriage

It is my will that my dear son Bennett Stevenson Morgan should have my books and silver coffee pot and stand and two of the best diamond rings which my dearly beloved wife desired might be reserved for him as a token of her affection and that my dear daughter Ann Lloyd Morgan agreeably to her mother’s desire should have her mothers gold watch and rings and cloaths

I give and bequeath to my dear sister Susan Winstone of the parish of Llywell or Trecastle in the county of Brecknock the sum of ten pounds

I give and bequeath to my highly valued friend Mr Henry Edward Hoose of the city of Bath the sum of two guineas as testimony of my esteem and gratitude

I do hereby revoke and make null all other and former Wills by me made and do declare this to be my last

And of this my last Will and Testament I constitute and appoint the aforesaid Pears Follard and William Nation my sole executors in trust to whom I give and bequeath two guineas each as the mark of the esteem and friendship my said executors receiving all the rents and profits of my estate paying all my just debts my funeral expenses and all my legacies within twelve months after my decease

I do hereby order and direct my said trustees to deduct and take out of the trust money all their necessary costs and expenses and that they shall not be answerable one for another or for the unavoidable loss of any of the trust money nor for any more monies than he or they shall actually receive

In witness whereof I have hereunto set my hand on seal this twenty ninth day of May one thousand seven hundred and ninety two Saml Morgan

Signed sealed published and declared by Samuel Morgan the testator as his last Will and Testament in the presence of us who have subscribed our names as witnesses J Pannell Elizabeth Pannell

This Will was proved at London the twenty ninth day of October in the year of our Lord one thousand seven hundred and ninety four before the Right Honorable Sir William Wynn Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oaths of the Reverend Pears Follard clerk and William Nation the executors named in the said Will to whom administration of all and singular the goods chattels and credits of the deceased was granted having been first sworn by commission duly to administer
