Will of Joseph Nosworthy late of Cullompton, Gentleman

I Joseph Nosworthy of Cullompton in the county of Devon gentleman being weak in body but of a sound mind memory and understanding do make and ordain this to be my last Will and Testament

First and principally I resign my soul to that beneficient being who gave it and trust by and assuredly hoping by his mercy and the intercession of his beloved son our Lord and Saviour Jesus Christ to be pardoned of all my sins and transgressions

And as to such estate and effects as it hath pleased God to give me I dispose of as follows

I give devise and bequeath and to John Davy of Bampton in the said county yeoman and Thomas Tayler of Cullompton aforesaid butcher their heirs and assigns all that my messuage or dwelling house in which I know reside in Cullompton aforesd with the courtilage outhouses gardens and orchard thereunto belonging and also all those my two cottages with the gardens orchard and field situate lying in and adjoining to Colebrook Lane in Cullompton aforesaid with their and every of their rights members and apurts upon the trusts and to and for the ends intents and purposes hereinafter mentioned expressed and declared of all and concerning the same that is to say

Upon trust as to that part of my said dwelling house called the hall or parlour the chamber over one half of my dairy house and one half part of my enclosed garden to permit Mary Nosworthy my wife to hold and enjoy the same for and during the term of her life

And as to the other part of the said dwelling house and all other the premises above mentioned with their and every of their appurts together with the part allotted to my said wife as aforesaid her life (after her decease) upon trust for my nephew Joseph Nosworthy (son of my brother Samuel) his heirs executors admors and assigns for ever

And whereas previous to my marriage to my said wife I secured to her by my bond the sum of four hundred pounds to be paid (in case she should survive me) to her at my death now I do hereby ratify and confirm the same

And in addition thereto do hereby give unto her the sum of one hundred and fifty pounds the whole to be at her own use and disposal except one hundred pounds part of the said one hundred and fifty pounds which said one hundred pounds I direct shall be paid back and returned to my executor hereinafter named on the death of her my said wife

I also give to her the my said wife one of my silver butter boats two silver pint cups four silver tables spoons and six silver tea spoons to be chosen by herself also one hogshead of cyder if I should leave two or more and one half of the wood and coals which shall be in my dwelling house and premises at the time of my death

Also all her own wearing apparel for her own use and disposal

Also such of my household goods as she shall make choice of for her own use during her life but at her death to be returned to my said executor

Also I give and bequeath unto my brother Samuel Nosworthy an annuity of two shillings and sixpence a week for his life to be paid by my said executor

Also I give to my sister Prudence Osborn of Exeter the sum of thirty pounds and one silver table spoon

Also to my sister Mary Searle the sum of fifteen pounds and one silver table spoon

Also to my sister Betty Edwards the like sum of fifteen pounds

Also to my sister Ann Nosworthy the sum of ten pounds only she being single and unmarried

Also I give to Samuel Nosworthy son of my late brother Samuel the sum of twenty pounds

And to the three daughters of my sister Prudence five pounds each

And also the sum of five pounds to my niece Mary Searle

Also I give to Mr George Row of Bampton aforesaid my brother in law the sum of five pounds

Also to the said Thomas Taylor the sum of one pound as a small acknowledgement for any trouble they may have in the execution of the trusts aforesaid

All which said legacies I direct shall be paid by my said executor within six months after my death

And I give my wearing apparel except my silver buckles to my said brother Samuel to my brother in law Thomas Osborn and my brother in law Benjamin Edwards to be divided between them at the discretion of my said wife and my executor within a month after my decease

And as to for and concerning all the rest residue and remainder of my lands tenements and heredits goods chattels money securities for money and personal estate whatsoever and wheresoever my debts legacies the said annuity and funeral expenses being thereout paid and discharged I give devise and bequeath unto my said nephew Joseph Nosworthy (son of my said brother Samuel) his heirs executors and administrators and do hereby appoint him whole and sole executor and residuary legatee of this my Will

In witness whereof I the said Joseph Nosworthy the testator have to this my Will containing three sheets of paper set my hand to the first two sheets and to the last my hand and seal the ninth day of December in the year of our Lord one thousand eight hundred and five

Signed sealed published and declared by the said Joseph Nosworthy the testator as and for his last Will and Testament in the presence of us who have subscribed our names as witnesses thereto in the presence and at the request of the said testator and in the presence of each other

This Will was proved at London the eighteenth of March in the year of our Lord one thousand eight hundred and six before the Right Honorable Sir William Wynne Knight Doctor of Laws Master keeper or commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of John Nosworthy the nephew of the deceased and the sole executor named in the said Will to whom administration of all and singular the goods chattels and credits of the said deceased was granted having been first sworn by commission duly to administer
