Will of John Oram of Cullompton, late Officer of Inland Revenue

This is the last Will and Testament of me John Oram of Collumpton in the county of Devon late Officer of Inland Revenue

I direct the payment of my just debts funeral and testamentary expenses as soon as convenient after my decease

I bequeath all my household furniture and wearing apparel unto my wife Mary Oram absolutely

I give devise and bequeath all my estate and interest of and in my messuage or tenement with the appurtenances situate at Collumpton in the county of Devonshire unto my wife Mary Oram for her own use and benefit

I devise and bequeath all my real estate of what nature or kind soever and also all my personal estate monies securities for money and other effects of which I may die possessed of (except such parts thereof as hereinbefore given to my wife Mary Oram) unto and to the use of Henry Quick of Lympstone in the county of Devon gentleman and William Oram the younger of Southmolton in the county of Devon accountant their heirs executors administrators and assigns according to the nature or tenure thereof respectively

Upon trust that they my said trustees or the survivor of them or other the trustees or trustee for the time being of this my Will do and shall stand possessed of the monies arising from or forming any part of my real estate upon trust

And I declare and direct my said trustees or trustee to apply the amount arising front my life policy so soon as convenient after receiving the same and such further sum shall be taken from my personal estate as may be required to effect the purchase of a convenient life annuity on the life of my daughter Sally Oram to the amount of thirteen pounds a year for her own use and benefit

I also direct my said trustees or trustee to call in and invest all other monies forming any part of my said trust estate in their or his name or names in or upon any of the public stocks or funds of Great Britain or upon government or real securities in England with powers to vary such investment or investments for any other of the same description at their or his discretion and to pay the net dividends interest and annual income thereof unto my wife Mary Oram during her natural life for her own use and benefit

And after her decease then upon trust I direct my said trustees or trustee for the time being to pay the whole of the net income arising from my estate unto my daughter Emma Barrett the wife of John Barrett during her natural life for her own use and benefit independent of any husband it being my desire that such income should be applied principally towards the better education of her daughters

And in the event of the decease of my said daughter Emma Barrett before her youngest daughter attains the age of eighteen years then upon trust I direct my trustees or trustee to apply such income towards the education and maintenance of my grandchild Emma Zillah Barrett until her youngest sister then living arrives at the age of eighteen years and at the end of that period and the mother being deceased then as to the residue of the said trust monies and also as to the residue of my personal estate of what nature or kind soever upon trust to pay thereout unto my grandchild Emma Zillah Barrett a moiety or one half of my estate and the remainder to pay and divide the same unto and equally between all the rest of the children of my daughter Emma Barrett or the issue of any deceased child or children such last named issue to take the part or share which his or her parent or parents would have taken if living

And in case of the death of my grandchild Emma Zillah Barrett previous to the period before named and leaving no issue then I direct that her share be divided equally between all her other sisters that may be then living and having descended from the same mother

I declare that so far as concerns the trusteeship of this my Will that vacancies occurring thereof by death in my lifetime or after my decease by disclaimer resignation incapacity residence out of England for six calendar months at any one time or otherwise shall from time to time be supplied by the other trustee for the time being or if none then by the disclaiming or resigning trustee or if none by my executors or administrators for the time being some or one of them and upon every appointment proper assurances of my trust estate by the time being shall be executed at the expense of such estate and every such new trustee shall have the same powers authorities and discretions as if he had been hereby appointed a trustee

And I declare that the trustees or trustee for the time being of this my Will shall be chargeable only to the extent of their or his own respective actual receipts and exempt from liability for involuntary losses and be entitled to retain to and for his and their own respective uses such sum or sums of money as shall be deemed reasonable for his and their traveling expenses and to allow to each other all of our disbursements and expenses incident to the trust of this my Will

I appoint the said Henry Quick and William Oram junior executors of this my Will and revoke all former Wills

In witness whereof I have hereunto set my hand this twenty eighth day of December one thousand eight hundred and fifty two John Oram

Signed and published by the said John Oram as his last Will and Testament in the presence of us present at the same time who at his request in his presence and in the presence of each other have subscribed our names as witnesses thereto
