Proved 21st July 1843 in the Archdeaconry Court of Exeter
Appeared personally Thomas Webber of the parish of Cullompton in the county of Devon builder and Charles Baker of the parish of Kentisbeare in the said county of Devon yeoman the executors named in the last Will and Testament of Stephen Pine late of the said parish of Cullompton farmer deceased who died on the twentieth day of February 1843
This is the last Will and Testament of me Stephen Pine of Cullompton in the county of Devon farmer
First I give devise and bequeath unto Thomas Webber of Cullompton aforesaid wheelwright and Charles Baker of Sainthill of the parish of Kentisbeare in the said county farmer all my leasehold property consisting of two cottages two gardens and one orchard called Allerwood Gate also two plots of ground called Allerwood Corner Fields all situate in the parish of Kentisbeare aforesaid
Also all my household goods and furniture (except what is hereinafter reserved for my wife Ann) likewise all my monies securities for money and every thing that I may die possessed of in trust as follows to allow my said wife to have one bed performed one round table two chairs and a sufficient quantity of plates dishes and tea things for her own use
And I request my trustees as soon as convenient after my decease to sell and dispose of all my household goods and furniture (except what I have given to my said wife) and all my implements in husbandry and divide the amount of such sale together with what money I may die possessed of between my said wife Ann and my two daughters viz Mary wife of Richard Scadding of Cullompton aforesaid labourer and Martha wife of James Coneybear of Kentisbeare aforesaid labourer share and share alike subject nevertheless to the payment of my just debts funeral expenses and the expense of proving this my Will
And if either of my said daughters should die then I give her share unto her children share and share alike to be paid them as they shall attain their respective ages of twenty one years
And I request my trustees to pay quarterly the rents issues and profits of my said leasehold property unto my said wife and to my said two daughters share and share alike during the lifetime of Nancy Radford of Kentisbeare aforesaid and whereas at the death of the said Nancy Radford I shall be entitled to the sum of twenty pounds I direct my trustees to pay the same unto my said wife and my two said daughters share and share alike immediately after the same is payable
And lastly I do hereby nominate constitute and appoint the said Thomas Webber and Charles Baker executors in trust of this my last Will and Testament and my will is and I do hereby direct that my said executors and trustees shall each of them be answerable for his own act and receipts only and not the one for the other of them and that they shall not be answerable for any loss or miscarriage
by any security or securities that may happen in my estate and that they shall retain all their costs charges damages and expenses out of the estate and effects in them respectively vested in and by this my last Will and the trusts therein contained
In witness whereof I have to this my last Will and Testament set and subscribed my hand the twelfth day of June one thousand eight hundred and forty one
