Appeared personally Amy Rice of Colompton in the county of Devon the executrix named in the last Will and Testament of Richard Rice of the same place currier who died on the sixteenth day of July 1827
This the last Will and Testament of me Richard Rice of Cullompton in the county of Devon currier made the sixth day of January in the year of our Lord one thousand eight hundred and twenty seven such as follows
First I give and bequeath unto my son Abel all my music books
Also I give and bequeath unto my sons Abraham and John the sum of five pounds
Also I give and bequeath unto my sons Richard and James and unto my daughter Sally the sum of five shillings each which several legacies I hereby direct shall be delivered from and satisfied by my executrix hereinafter named within twelve calendar months next after my death
And whereas there is now due to me from John Marker of Broadhembury cordwainer the sum of twenty pounds for goods sold and delivered I do therefore give and bequeath the same or such part thereof as shall be due at the time of my death unto my son Robert and I hereby impower him to sue for and recover the same at law or by any other such ways or means as he may think proper
And whereas my said son Richard is indebted to me in the sum of forty nine pounds and I have agreed to accept and receive the same by instalments at the sum of ten pounds a year until the said sum of forty nine pounds shall have been paid and satisfied and in case the said some of forty nine pounds or any part thereof shall be due and owing to me and unpaid at the time of my death I hereby direct and declare and my will is that my said son Richard shall pay so much of the said sum of forty nine pounds as shall be then due to me by such instalments and at the rate aforesaid unto my daughter Amy until the same shall all be fully discharged and satisfied and I do hereby give and bequeath the same to my said daughter Amy accordingly and declare that the receipt of her alone shall be a proper and sufficient discharge for the same
And whereas Thomas Walker of Kerswell cordwainer is also indebted to me in the sum of forty pounds for goods sold and delivered my will is therefore and I do hereby give and bequeath the said sum of forty pounds or such part thereof as shall be due at the time of my death unto my said daughter Amy and all my right and interest therein
I also give devise and bequeath unto my said daughter Amy or that messuage tenement or dwelling house called Turners Tenement and the garden and outhouse thereto belonging one part of which is now in my occupation and the other in the occupation of my said son Richard subject nevertheless to the payment of the sum of one hundred pounds now due thereon to hold the same with the appurtenances (subject as aforesaid) unto my said daughter Amy forever
All the rest residue and remainder of my estate and effects household goods and furniture and all my linen and books (except the books hereinbefore disposed of) china glass clock and case earthenware and clothes subject to the payment of my funeral expenses and the legacies hereinbefore by me given I give and bequeath the same unto my said daughter Amy whom I appoint whole and sole executor of this my Will and revoking any other will by me at any time heretofore made I ratify and confirm this to be my last
In witness whereof I have to this my last Will and Testament contained in two sides of paper set by hand and seal the day and year aforesaid Richd Rice
Signed sealed published and declared by the said Richard Rice the testator as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses hereto
