Will of John Rutley late of Cullompton, Worsted Weaver

Memorandum That upon the eight day of June in the yeare of our Lord God one thousand six hundred fiftie and six I John Rutley of Collumpton in the countie of Devon worsted weaver now deceased being sick of bodie but of good and perfect did in the presence of Roger Manning of Collumpton haberdasher of George Upcott of Collompton aforesaid fuller and in the presence of Marie then wife of the said John Rutley made and declare his last will nuncupative or by word of mouth in manner and forme following (that is to say)

the said John Rutley being demanded by the said Roger Manning how he did intend to leave his effects or goods after his decease and what his said wife and child should have he presentlie replyed thereunto in the presence and hearing of the said Roger Manning and George Upcott and of the said Marie his wife that his sonne John Rutley being his onlie child and then lastlie borne should be his executor and his debts being paid his wife Marie should have and injoy the residue of his goods untill his said sonne did come to yeares and the said Marie should be in trust for the said child during that time or used words to the same effect and in his pfect memorie and shortlie after died

In witness hereof we the said Roger Manning and George Upcott have hereunto set our hands the fouer and twentith day of June in the foresaid yeare of our Lord God one thousand six hundred fiftie six George [ Up ] his mark Roger Mannynge

The thirteenth day of August in ye year of our Lord God one thousand six hundred fifty and six by the Judges for probate of Wills and granting Administrations lawfully authorized were granted letters of administration to George Hill curator or guardian lawfully assigned to John Rutley a minor the sonne and executor named in the above written last Will and Testament nuncupative of John Rutley late of Collumpton in the county of Devon deceased to administer the goods chattells and debts of the said deceased according to the tenor and effect of the said deceased Will and to the use and during the minoritie and to the use and benefit of John Rutley the sole executor to whome administration was committed he being first legallie sworne by virtue of a commission dulie and faythfully to administer the same
