Appeared personally Richard Mortimore of Cullompton in the county of Devon gentleman the sole executor named in the last Will and Testament of John Salter late of Cullompton, gentleman who died on the 16th day of October 1837

I John Salter of Cullompton in the county of Devon yeoman being of a sound mind memory and understanding do make and ordain this to be my last Will and Testament in manner following (that is to say)

I give and bequeath unto my friend Richard Mortimore of Cullompton aforesaid gentleman all my monies securities for money goods chattels and effects whatsoever upon such trusts and to and for such uses ends intense and purposes as hereinafter mentioned of and concerning the same (that is to say)

That he the said Richard Mortimore do and shall pay over the interest dividends and produce thereof unto my wife Susanna Salter (but I married her by the name of Sarah but nevertheless I hereby declare her to be my true and lawful wife and to be deemed and taken as such under this my Will) for and during the term of her natural life or so long as she shall remain my widow which shall first happen

And from and immediately after her death or marriage then upon trust that he the said Richard Mortimore do and shall pay unto my nephews and nieces John Baker, Thomas Baker, Edward Baker, William Baker, Sarah Baker, Margaret Baker, Elizabeth Baker, Mary Baker and Anstice Baker children of my sister Ann Baker the son of ten pounds

Also to my two nieces daughters of my brother Chas Salter the sum of ten pounds each but in the event of George Howard not paying me the ten pounds which I have already advanced him I hereby revoke the said gift of ten pounds so given to his wife

To my nephew Charles Salter son of my said brother Charles Salter the sum of one hundred pounds

To Henry Mountstephen son of the late John Mountstephen the sum of ten pounds

And it is my will and mind that from and after the payment and satisfaction of the aforesaid legacies that my trustee Richard Mortimore (or Mark Farrant the younger of Cullompton aforesaid gentleman in the event of the said Richard Mortimore dying before the trusts of this my Will shall be carried into effect and thereby request the said Mark Farrell to take upon himself the burthen and execution thereof and to act therein as in case he had been appointed as a co-trustee with the said Richard Mortimore and I hereby fully empower him so to do) do and shall pay over the remainder or surplus of the said trust monies chattles and effects unto my great nephew John Salter son of my nephew Robert Salter when he shall attain his age of twenty one years and to and for no other use or benefit

Provided always nevertheless and in case the said John Salter shall happen to die before he shall attain the said age of 21 yrs unmarried and without issue I hereby direct my trustee for the time being to pay over all such money and effects which he shall happen to have undisposed of unto and amongst all and every my nephews and nieces share and share alike as tenants in common

And I do hereby constitute and appoint the said Richard Mortimore executor in trust of this my last Will and Testament and I do hereby further declare that it shall and may be lawful to and for my said trustee for the time being to retain and reimburse himself out of my estate and effects all such costs charges and expenses as he shall sustain or be put unto in or about the management and execution of the trusts aforesaid

And lastly I do hereby revoke and make void all former Will and Wills by me heretofore made In witness whereof I the said John Salter have hereunto set my hand and seal the thirteenth day of September one thousand eight hundred and thirty seven John Salter (Seal)

Signed sealed and published by the said John Salter the testator as and for his last Will and Testament in the presence of us who have subscribed our names as witnesses hereto at his request in his presence and in the presence of each other
