Appeared personally Samuel Fry and Thomas Turner both of the parish of Cullompton in the county of Devon weavers the executors named in the last Will and Testament of Thomas Shiles late of the parish of Cullompton aforesaid woolcomber deceased who died on the twenty ninth day of December 1837
This is the last Will and Testament of the Thomas Shiles of Cullompton in the county of Devon woolcomber
I give devise and bequeath unto Samuel Fry of Cullompton aforesaid weaver and Thomas Turner of the same place weaver their executors and administrators all my dwelling houses gardens and premises with the appurtenances thereunto belonging
Also all my monies securities for money household goods and furniture and every thing that I may die possessed of in trust as follows
First I give devise and bequeath unto my daughter Hester wife of William Baker of Cullompton aforesaid labourer all that my dwelling house and garden situate in New Street in which she now resides during the term of her natural life independant of her present or any future husband
And from and immediately after her decease I give devise and bequeath the said dwelling house and garden unto my grandson William son of the said William Baker but in case my said grandson should die before he attains the age of twenty one years then I give devise and bequeath the same unto my granddaughter Lydia daughter of the said William Baker her exors admors and assigns
I give devise and bequeath unto my son Thomas all that my dwelling house and garden in which I know reside situate in New Street during the term of his natural life and from and immediately after his decease then I give devise and bequeath the same unto my grandson Thomas son of the said William Baker his exors admors and assigns
And I direct that the said two dwelling houses shall be kept in good repair by my said daughter Hester and my said son Thomas and to keep the same insured
I give devise and bequeath unto my son Samuel his exors admors and assigns all that my dwelling house and garden situate in New Street now in the possession of Henry Blackmore as tenant thereof
As to my dwelling house and garden situated at Stonyford now in the possession of Giles Bennett as tenant thereof I request my trustees to pay from the first rents that they may receive for the same the sum of ten pounds for binding my said grandson Thomas to a trade also the sum of ten pounds for binding my said grandson William to a trade
And after payment of the said twenty pounds from the rents of the said premises I give and bequeath the rents thereof afterwards between my said two sons Thomas and Samuel and my said three daughters Elizabeth Ann and Hester to be divided between them annually share and share alike until my grandson Richard the son of Richard Trew late of Bristol chaise driver shall attain his age of twenty one years
And when my said grandson Richard Trew shall attain his age of twenty one years then I direct my trustees to sell and dispose of the said dwelling house and garden at Stonyford and divide the amount that the same may be sold for between my said two sons and three daughters share and share alike first paying unto my said grandson Richard Trew the sum of ten pounds and my granddaughter Hester Trew his sister the sum of ten pounds
I give and bequeath unto my said two sons and my said three daughters all my monies securities for money household goods and furniture and every thing that I have not already given to be divided between them share and share alike as soon as convenient after my decease subject nevertheless to the payment of my just debts funeral expenses the expense of proving this my Will
And lastly I do hereby nominate constitute and appoint them the said Samuel Fry and Thomas Turner executors in trust of this my last Will and Testament and my will is and I do hereby direct that my said exors and trustees shall each of them be answerable for his act and receipt only and not the one for the other of them and that they shall not be answerable for any loss or miscarriage by any security or securities that may happen in my estate and also that they shall retain all their cost charges damages and expenses out of the estates and effects in them respectively vested in and by this my Will and the trusts therein contained
In witness whereof I the said Thomas Shiles have to this my last Will and Testament set and subscribe my hand and seal the fifth day of November one thousand eight hundred and thirty seven Thos Shiles
Signed sealed published and declared by the said testator Thomas Shiles as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto set and subscribed our names as witnesses thereto
