In the name of God Amen I John Short of Cullompton in the county of Devon surgeon being in good health and of a sound and disposing mind and understanding thanks be given to Almighty God for the same but being bound on a voyage to sea and considering the certainty of death and of the uncertainty of the time and place thereof I therefore this fifteenth day of May in the year of our Lord one thousand seven hundred and sixty two make and ordain this to be my last Will and Testament
I give and bequeath unto my good friend Benomi Peters of Cullompton aforesaid surgeon all and singular my money securities for money prize money insurance money wages debts and all other my personal estate of what nature or kind soever or wheresoever to hold to him the said Benomi Peters his executors and administrators and assigns upon trust nevertheless that the said Benomi Peter’s his exors admors and assigns do and shall as soon as conveniently may be after my death receive all my said personal estate (whose receipt upon receiving the same or any part thereof shall be a sufficient discharge to the person or persons paying the same)
And in the first place pay and discharge thereout all my just debts and in the next place pay over to my mother Mary Short all the rest and residue of my moneys and personal estate for her own use in such parts and proportions and at such time or times as he or they shall think proper
But in case my said mother should not happen to survive but die before me then to pay and distribute all my said moneys and personal estate unto such of my brothers or sister as he or they shall think most deserving the same
And I do hereby constitute and appoint the said Benomi Peters executor of this my Will and lastly I do hereby revoke and make void all former Will and Wills by me heretofore made and declare this to be my last In witness whereof I the said John Short have hereunto set my hand and seal the day and year above written John Short
Signed sealed published and declared by the said John Short as and for his last Will and Testament in the presence of us who have subscribed our names as witnesses hereto in the presence of and at the request of the testator Mary Toogood Hen Brutton
This Will was proved at London the nineteenth day of July in the year of our Lord one thousand seven hundred and sixty three before the Right Worshipful Sir Edward Simpson Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of Benomi Peters the sole executor named in the said Will to whom administration was granted of all and singular the goods chattels and credits of the deceased having been first sworn by commission duly to administer
