Proved 23rd March 1853 in the Archdeaconry Court of Exeter
Appeared personally Thomas Webber of Cullompton in the county of Devon builder (power being reserved to William Toogood of Cullompton aforesaid banker) one of the trustees & executors named in the last Will and Testament of George Southey late of Cullompton aforesaid maltster deceased who died on the 5th day of September 1852
This is the last Will and Testament of me George Southey of Cullompton in the county of Devon maltster made this thirtieth day of May one thousand eight hundred and fifty
I give devise and bequeath unto my two friends William Toogood banker and Thomas Webber builder both of Cullompton aforesaid and the survivor of them and the executors and administrators of such survivor all my lands messuages tenements hereditaments and premises households goods monies and securities for money wheresoever the same shall or may be found
In trust in the first place to pay all my just debts funeral and testamentary expenses and the expenses of seeking to obtain possession of the setting
Then upon trust to pay over all the rents interests and profits thereof unto my wife Mary Southey until my son George Southey shall attain his age of twenty one years if she should so long live and remain my widow but not otherwise
But if she should marry then my will is that my said trustees pay unto my said wife Mary Southey the sum of twenty pounds and likewise my household goods except my camp bedstead and furniture and one boxed marked GS which I give unto my said son George Southey
Then from and immediately after the marriage of my said wife upon trust for my said son George Southey until he shall attain his age of twenty one years and then if my said wife Mary Southey shall remain my widow I then give to my said son George Southey the sum of nineteen guineas only
But if my said wife shall again marry or die in either case that my said trustees shall release and give up unto my said said son George Southey all my lands messuages tenements hereditaments and premises and pay over all the interest effects dividends and proceeds thereof on his attaining the age of twenty one years and to his executors administrators and assigns
Except my said wife Mary Southey shall then be living and still remain my widow then my will is that my said trustees pay over all the rents and interest except that of the said nineteen guineas which I give to my said son George Southey at his attaining the age of twenty one years unto my wife the said Mary Southey during her natural life if she shall so long remain my widow but not otherwise except my said son George Southey should not live to attain the age of twenty one years then my will is to give unto my said wife Mary Southey all my lands messuages tenements hereditaments and premises interest effect dividends and proceeds and to her executors admors and assigns
But if my said wife Mary Southey and my said son George Southey should both die before that my said son George Southey shall attain his twenty one years of age and should marry and leave a lawful issue or issues to him or them then I give all my lands messuages hereditaments tenements and premises and all my effects whatsoever unto each and every of them as tenants in common
But if no lawful issue be left of my said son George Southey and my said wife should so die then and in such case I give unto the said trustees named in this my Will the said William Toogood and Thomas Webber the sum of fifteen pounds each
And I hereby declare my said trustees the said William Toogood and Thomas Webber shall not be answerable or accountable for any acts deeds or defaults of the other of them nor for any more monies than shall actually come into their hands by virtue of these presents and that each and every of them shall and may reimburse themselves and each other all costs and expenses that they may be put unto in or about the execution of the trusts of this my Will or any wise in relation thereto
And I hereby revoke all over Wills by me at any time heretofore made and I do declare this to be my only last Will and Testament in witness whereof I have hereunto set my hand and seal the day and year first above written
