Proved 8th December 1840 in the Archdeaconry Court of Exeter

Appeared personally Elias Jarman of Cullompton in the county of Devon builder one of the executors named in the last Will and Testament of John Stark late of Cullompton aforesaid yeoman deceased who died in December 1839

This is the last Will and Testament of me John Stark of Cullompton in the county of Devon yeoman

First I give and bequeath unto Elias Jarman of the same place builder and Richard Harvey also of the same place grocer all that my dwelling house garden and premises situate in New Street in Cullompton aforesaid in which I now reside also all my monies securities for money household goods and furniture and everything that I may die possessed of in trust as follows requesting them to place out all monies that I may die possessed of on good security in trust for my wife Ann during the term of her natural life as long as she shall remain my widow subject nevertheless to the payment of my just debts funeral expenses and the expense of proving this my Will and I request them the said Elias Jarman and Rd Harvey to allow my said wife to reside in my said dwelling house in New Street

And from and immediately after the decease or intermarriage of my said wife I request my trustees to sell and dispose of my household goods and furniture

Then I give devise and bequeath my said dwelling house garden and premises unto my daughters Anna and Susanna their heirs and assigns share and share alike but in case one of them should die without issue and unmarried then I give the same to the survivor of them

I give and bequeath unto my daughter Mary wife of Robert Blake of Sidmouth in the said county labourer the sum of ninety pounds

I give and bequeath unto my daughter Ann wife of John Tuck of Cullompton aforesaid the sum of twenty pounds independent of her present or any future husband and her receipt alone shall be a discharge for the same

I give and bequeath unto my daughter Elizabeth wife of Joseph Sanders of Aylesbeare in the said county dairyman the sum of ninety pounds

I give and bequeath unto my daughter Amy wife of Thomas Searle of Cullompton aforesaid weaver the sum of twenty pounds

I give and bequeath unto my granddaughter Elizabeth daughter of my said daughter Amy the sum of one pound to be paid her when she attained the age of twenty one years but in case she should die before she attains the age of twenty one years and unmarried then I give and bequeath the same unto my said daughter Amy

I give and bequeath unto John son of the said John Tuck the sum of five pounds to be paid him when he attains the age of twenty one years but in case he should die before he attains the age of twenty one years and unmarried then I give and bequeath the same unto my said daughter Ann

I give and bequeath unto Ann daughter of the said Joseph Sanders the sum of five pounds to be paid her when she attains the age of twenty one years but in case she should die before she attains the age of twenty one years and unmarried then I give and bequeath the same unto my said daughter Elizabeth

And as to all the rest residue and remainder of my effects I give and bequeath the same unto my two daughters Anna and Susanna share and share alike but in case one of them should die without issue and unmarried then I give and bequeath her share unto the survivor of them

And lastly I do hereby nominate constitute and appoint them the said Elias Jarman and Richard Harvey executors in trust of this my Will and I hereby direct that my said executors and trustees shall each be answerable for his own acts and receipts only and not the one for the other of them and that they shall not be answerable for any loss or miscarriage by any security or securities that may happen in my estate and also that they shall retain or their cost charges and expenses out of the estate and effects in them respectively vested in and by this my Will and the trusts therein contained

In witness whereof I have to this my last Will and Testament set and subscribed my hand this twenty seventh day of October 1838

Signed published and declared by the said testator John Stark as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses thereto
