Will of Thomas Sumpter late of Collompton, Clothier

To all to whome theise prites shall come greetings I Thomas Sumpter of Collumpton in the countie of Devon clothier doe make this my last Will and Testament the fouerteenth day of Aprill in the one and twentieth yeare of the raigne of our Sovereigne Lord Charles by the grace of God of England Scotland France and Ireland king defender of the faith etc Anno Dom one thousand six hundred fortie five in manner and forme following that is to say

I give to the poore of the parish of Collumpton aforesaid fortie shillinges and to the poore of Tiverton in the county aforesaid fortie shillinges to be distributed by the overseers of this my Will hereafter named within one month after my decease in such manner and forme as they shall think fitt

Item I give and devise unto my beloved wife Margaret Sumpter the messuage tenement and land called Turnett als Branscombes place sittuate lying and being in or neare Collumpton aforesaid to hould unto my said wife during her life

And after her disease I doe give and devise the same messuage tenement and lande unto my brother Giles Sumpter to hold unto him during his life

After the decease of my said wife and after the death of my said brother Giles Sumpter I doe give and devise forever the said messuage tenemt and land and to the heires of the bodie of my brother William Sumpter lawfully begotten or to be begotten

Also I give and devise unto my sisters Joane Sumpter and Marie Sumpter to be equally divided betweene them all that my great meadowe lying and being on the east side of Collumpton aforesaid and all the estate right title interest terme of yeares claime and demande which I have therein or thereunto to hould unto my said sisters Joane and Marie immediately from and after the decease of my said wife for and during all the residue and remainder of yeares which shalle therein then to come and unexpired

Alsoe I give and bequeath unto my said brother Giles Sumpter and unto my said sisters Joane Sumpter and Marie Sumpter and unto my sister Agnis Sumpter and unto John Kinslake William Charles and Mary Kinslake twwentie shillinges apiece to be paid unto them in three months after my decease

Also I doe give and devise unto the overseers of this my Will all that my quarter part or foureth parte of two messuages or tenements called by the name of Pothaies and Broomehills and all landes and grounds with the appurtenances belonging to my parte of the same two tenemts sittuate lying and being in the parish of Cullompton aforesaid to hould unto them for and during the life of my said brother Giles Sumpter uppon this trust and confidence that my said overseers shall pay unto my said brother Giles during his life the rents issues and proffits of the said land last mentioned for his livelyhood and maintenance

And after the decease of my said brother Giles Sumpter I doe give and devise my quarter part of the said two messuages or tenements and all landes and groundes to the same belonging with the appurtenances unto the heires of the bodie of my said brother Giles Sumpter forever

Also I doe give and bequeath unto my said wife Margaret all the rest and residue of my goods and chattells rights and credits and I do make and ordayne her the said Margaret to be whole and sole executor of this my last Will and Testament

Also I doe desire and appoint my loveing friends Mr Abraham Turner of Collumpton Mr George Thorne of Tiverton Mr William Goodhine and my brother William Sumpter of Collumpton clothier to be overseers of this my Will desiring them to be ayding and assisting unto my loving wife in the management of my estate after my decease and to every of my said overseers as the token of my love and thankfulness unto them I doe give and bequeath a gould ringe of twentie shillings price with this inscription Memento Mori

And I doe hereby desire and request my beloved wife that in case she shall dye without yssue of her bodie to give and devise all the tenement called Bollum in the parish of Tiverton unto her sister Marie Kinslake

And in testimonie that this is my last Will and Testament I have hereunto putt my hand and seale the day and yeare first above written Thomas Sumpter

Signed sealed and published by the said Thomas Sumpter to be his last Will in the presence of
