Proved in the Principal Registry of the Lord Bishop of Exeter 22nd April 1828

Appeared personally John Philip Sydenham of Cullompton in the county of Devon clerk the son and sole executor named in the last Will and Testament of John Sydenham late of Cullompton aforesaid clerk who died on the fifteenth day of December 1827

In the name of God Amen I John Sydenham of Cullompton in the county of Devon clerk being of sound and disposing mind memory and understanding do make publish and declare this my last Will and Testament in manner and form following (that is to say)

First I give devise and bequeath unto my only son John Phillip Sydenham of Cullompton aforesaid gentleman all those my freehold messuages lands tenements hereditaments and premises with the appurtenances whereof I am seized in fee situate lying and being in the parish of Highbray in the said County of Devon now or late in the several tenures or occupations of Philip Ridden his undertenants or assigns to have and to hold all and every the said lands tenements and hereditaments situate as aforesaid to him the said John Philip Sydenham his heirs and assigns for ever subject nevertheless to the life estate of my dear wife his mother under and by virtue of the marriage settlement made by me previous to my marriage with my said wife and further subject as hereinafter is mentioned

Also I give devise and bequeath unto my said son John Philip Sydenham all those my freehold messuages lands tenements and hereditaments with the appurtenances whereof I am also seized in fee situate lying and being in the several parishes of Ashreigney otherwise Kingsash Burrington Cullompton Kingsnympton and Warkley in the said county of Devon now or late in the several tenures or occupations of Willm Stevens John Wright William Buckingham [ ] Skinner [ ] Saunders and Richard Pickhard or their undertenants and of myself

And also all my leasehold premises both in possession and reversion in the said parish of Cullompton part of which isnow in my own possession and other part of which I am intitled unto for two lives in reversion of one life now existing to have and to hold all and every the said lands tenements and hereditaments with the appurtenances unto the said John Philip Sydenham his heirs executors administrators and assigns according to their respective tenures

Subject nevertheless to my said wife’s interest therein to whom I give the same for her life if she shall so long continue my widow but not otherwise

And subject also and chargeable with the payment of two thousand pounds apiece to my three daughters Frances Margaret and Mary Sydenham from and immediately after the determination of my said wife’s estate therein

And it is my further will and mind that if the said freehold and leasehold estates hereby last devised and bequeathed shall prove insufficient to make up the full sum of two thousand pounds apiece to my said three daughters that all my other property hereinbefore or hereinafter devised and bequeathed shall be subject and liable to make up the deficiency

All the rest residue and remainder of my freehold and leasehold estates whatsoever and wheresoever and all my goods chattles and effects subject to the life of my said dear wife as aforesaid and to the payment of all my just debts and funeral expenses I give devise and bequeath unto my said son John Philip Sydenham to have and to hold to him his heirs executors administrators and assigns and do make him the said John Philip Sydenham whole and sole executor residuary legatee and devisee of this my Will

In witness whereof I the said John Sydenham have to this my Will written on four sheets of paper to the first three sheets set my hand and to this last my hand and seal this fifteenth day of May one thousand eight hundred and twenty six John Sydenham

Signed sealed published and declared by the said John Sydenham as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses thereto Robert Baker Holway Carew John Fowler
