Proved 12th January 1849 in the Archdeaconry Court of Exeter
Appeared personally William Dommett of the parish of Rushton in the county of Somerset yeoman and John Frost of Broadclist in the county of Devon yeoman two of the trustees and executors by implication named in the last Will and Testament of Joseph Taylor late of Batthills in the parish of Cullompton in the county of Devon yeoman who died on the third day of July 1848
I Joseph Taylor of Batthills in the parish of Cullompton do by this my Will give devise and bequeath all my landed and other property to Joseph Crabb of Stoke Saint Mary William Dommett of Rushton and John Frost of Upton Cullompton yeomen in trust for the use and benefit of my wife and children as follows;
To pay the rent and interest to my wife until her marriage then to her or such other person or persons as my trustees may think proper towards the maintenance and education of my children and I empower the trustees to sell the whole or any part of the property and to apply the same or any other part of the property for the use and benefit of my wife and family according to their discretion but not without the consent of my wife should she be living the remainder to be divided amongst my children as my wife shall by her Will direct
And in default of such Will then between such of my children as may be then living or to the representatives of such as may be dead, at such times and in such proportions as my trustees may think proper my wish being that it should be divided equally between them deducting the amount any of them many may have had applied for their benefit, but should any of them conduct themselves to the disapprobation of my wife or trustees I empower them to withhold from such child the whole or any part of his or her portion and to apply the principal or interest thereof but the benefit of any of my children or their family as they may think proper
