In the name of God Amen I George Trosse of Cullompton in the county of Devon gentleman being weak in body but of a sound and disposing mind and memory thanks be given to Almighty God for the same and calling to mind the uncertainty of this mortal life and all that flesh and but as grass do make and ordain this my present last Will and Testament revoking all former Wills and Testaments heretofore by me formerly made as null and void to all intents constrictions and purposes whatsoever but this only to stand remain and abide in full force and strength in manner and form as follows
First of all I commend my soul into the hands of Almighty God my greater trusting and steadfastly believing in and through the meritorious death of my Lord and Saviour Jesus Christ to receive full pardon and remission of all my sins and my body I commit to the earth from whence it was taken there to be interred in a decent matter at the discretion of my executrix hereinafter named
And as to making touching such worldly estates goods and chattels lands and tenements which by the providence of God I am in any wise interested in or intitled unto either at law or equity lying and being within the Kingdom of Great Britain I give devise and bequeath in manner and form following
First I will that all my debts and legacies be paid and discharged in manner as followeth
Imprimus I give and bequeath we unto my cousin Mary Cockram daughter of Dr George Cockram decd a mourning ring of the value of one guinea and to my prentice maid Elizabeth Reynells forty shillings in case she served out her apprenticeship with my dear wife Sarah Tross and not otherwise and then to be paid her by my executrix and not before
Item I give devise and bequeath unto my dear wife Sarah Trosse her heirs executors and assigns all that my messuage tenement or burgage and a field or close of land thereunto belonging with their appurtenances and also all gardens courts outlays backfields easements profits commodities and hereditaments whatsoever thereto belonging in any wise appertaining with their and every of their appurtenances and also all my estates right tithe and interest claim and demand whatsoever both at law and equity and the equity of redemption thereof together with all deeds evidences and writings relating thereto or concerning the same and called or commonly known by the name of the Squirrel Inn lying in the town of Wellington in the county of Somerset
Item I give devise and bequeath unto my dear wife Sarah Tross and her executors and administrators and assigns all those my two messuages tenement or farms commonly called or known by the name of Higher Growens als Growhayse and Lower Growens als Growhayse and Willbine Mead and also all courts curtilages gardens orchards fields closes and parcels of land meadow and pasture and coppices and furse break thereunto belonging within the parish of Cullompton within the said county of Devon and now in mine or my tenants possession
And also all ways paths waters watercourses easements profits commodities and advantages whatsoever thereunto belonging or in any wise appertaining for and during the term of one thousand years fully to be expired
Upon trust nevertheless and to and for this only intent and purpose that my said dear wife Sarah Trosse shall have full power and authority to demise and grant by any deed or deeds well and duly executed by her the said two messuages tenements or farms called Higher and Lower Growens als Growhayse and Willbine Mead for any estate term or terms of years not exceeding nine hundred and ninety years to levy and raise such sum or sums of money as and or shall be sufficient to pay my debts and legacies
And from and after the raising and paying of money sufficient to pay my said debts and legacies then I give and devise all those my said two tenements messuages or farms called and Higher and Lower Growens als Growhayse and Willbone Meade unto my said dear wife Sarah Trosse for and during the term of sixty years if she shall happen to live so long
And from and after her decease then I give and devise the said two messuages tenements or farms called Higher and Lower Growens als Growhayse and Willbone Meads and all my estates tithe and interest there in both that law and equity unto my two daughters Dorothy Trosse and Sarah Trosse their heirs executors and assigns forever
Item I give and bequeath all my tythe of corn and graine arising renewing growing or becoming due or which hereafter shall arise renew grow or become due out of in or upon the said two messuages tenements or farms called Higher and Lower Growens als Growhayse and Willbone Meade or any part thereof and also out of in or upon all those four fields or closes of land one whereof is called House close in possession of John West my tenant one other close called Path close in the possession of John Vinicombe my tenant and two other closes called two five acres now in the possession of Thomas Baker sadler my tenement and also the tythe of corn and grain growing arising renewing or becoming due or which shall hereafter grow arise renew or become due out of in and upon one close now in the possession of Jacob Wood my tenant and out of in and upon three other closes of land now in the possession of Humphrey Phillipps my tenant unto my said dear wife Sarah Trosse and her assigns for and during the term of sixty years if she shall happen to live so long
And from and after her death I give and devise the said tythes with the appurtenances unto my said two daughters Dorothy Trosse and Sarah Trosse their heirs and assigns forever
Item I give devise and bequeath unto my said dear wife Sarah Trosse and her assigns all the said four closes called House close Path close two lower five acres and the said close in Jacob Woods possession and the said three closes or parcels of land or meadows in the possession of Humphrey Phillips and also all that my messuage or tenement backside gardens and orchard with their appurtenances in my possession for and during the terms of sixty years if my said wife shall live so long
And from and after her decease then I give and devise the said four closes called House close Path close two lower five acres the said Jacob Woods close and the three clothes or parcels of land and meadow in the possession of the said Humphrey Phillipps and all that messuage or tenement backside garden and orchards wherein I now dwell and in my possession unto my two said daughters Dorothy Trosse and Sarah Trosse their heirs executors and assigns forever and also all my estates interest claim and demand both in law and equity of in and to the same
Item all that messuage or tenement backside and gardens courts and barns with their appurtenances lying in Cullompton aforesaid now in the possession of Thomas Webber I give devise and bequeath unto my said dear wife her heirs and assigns forever in trust to make sale thereof either by leasing the same for any term or terms determinable on lives or otherwise as she shall think fit or by sale of the inheritance thereof and with the money to be arisen by such sales thereof to pay my debts and legacies
And as to touching and concerning all my high rents and all such moneys now in purse or due to me by bills bonds mortgagees or otherwise from any person or persons whatsoever with all my other goods and chattells of what nature or kind soever I give and bequeath to the aforesaid Sarah Trosse my dear wife whom I make and ordain my whole and sole executrix of this my last Will and Testament containing on sheet of paper
