Appeared personally Richard Way of Cullompton in the county of Devon weaver and William Poole of the same place cordwainer the two executors of Thomas Turner late of Cullompton, weaver who died on 20th day of July 1854
This is the last Will and Testament of me Thomas Turner of Cullompton in the county of Devon weaver which I publish and declare as follows
I give to Elizabeth Fear of Shepton Mallet spinster the sum of four pounds, to Elizabeth Taylor my housekeeper, the like sum of four pounds, to Ann Milton the wife of George Milton the sum of four pounds, to Thomas Were of Tiverton dairyman the sum of four pounds, to Hannah Langham the wife of Frances Langham the sum of four pounds and to Mary Bridgman spinster the sum of four pounds which said several sums I give to the several legatees above named for the purposes of buying mourning
I give and devise unto Richard Way of Cullompton aforesaid weaver and William Poole of the same place cordwainer their executors administrators and assigns all those my two leasehold dwelling houses and premises with their appurtenances now occupied by myself and James Saunders upon trust as soon as a practicable after my decease to sell and dispose of the said dwelling house and premises with their appurtenances either by public auction or private contract as they shall think fit for the best price they can obtain and out of the monies realized thereby to pay off the mortgage due thereon also to pay the said several legacies and all my just debts funeral and testamentary expenses and the expenses of such sale
And as to the surplus money remaining after the several payments aforesaid I give the same unto Mary Sidwells the wife of John Sidwells for her own sole and separate use and benefit and I hereby declare that her receipt alone shall be a sufficient discharge for my said trustees notwithstanding her coverture
And I hereby declare that all receipts given by my said trustees to purchasers and others for the purposes of this my Will shall be valid and effectual in all cases and that my said trustees shall not be responsible for any more monies than they shall respectfully actually receive nor the one for the other of them nor for any monies placed in any bank for security nor for involuntary losses unless the same shall happen through their or either out their willful neglect or default and that they shall be at liberty to deduct out of any trust monies all reasonable expenses they or either of them shall incur about the execution of the aforesaid trusts I give and devise all real and personal estates vested in me as mortgagee or trustee unto the said Richard Way and William Poole their heirs executors administrators and assigns subject to the trusts and equities affecting the same respectively
All the rest residue and remainder of my personal estate goods chattels and effects whatsoever and wheresoever I give unto the said Mary Sidwells her executors administrators and assigns and I appoint the said Richard Way and William Poole executors in trust for fulfilling the purposes of this my Will hereby revoking all former Wills
In witness whereof I have hereunto set my hand this fifth day of April one thousand eight hundred and fifty two Thomas Turner
Signed by the said testator as his last Will and Testament in the presence of us present at the same time who in his presence and in the presence of each other have hereunto subscribed our names as attesting witnesses
