William Voisey of Cullompton in the county of Devon cordwainer the sole executor named in the last Will and Testament of John Voisey late of the same place yeoman who died on the thirtieth day of August 1823

This is the last Will and Testament of me John Voisey of the parish of Cullompton in in the county of Devon yeoman (but now confined by illness in the parish of Ottery Saint Mary in the said county) made this twenty third day of August in the year of our Lord one thousand eight hundred and twenty three in manner following (that is to say)

In the first place I give unto my son John Voisey the sum of sixty pounds I also give to my daughter Jane the wife of William Toogood the like sum of sixty pounds I also give unto my son William Voisey the sum of eighty pounds

All the rest residue and remainder of my estate and effects subject to my just debts funeral and testamentary expenses I give and bequeath unto my said son William Voisey who I do hereby nominate constitute and appoint sole executor of this my last Will and Testament

And whereas the illness which now confines me is a broken bone and which took place in the town of Ottery St Mary aforesaid occasioned by a heap of earth being carelessly left in the street and which upset the chaise which I was then driving and I hope that the parish of Ottery St Mary aforesaid or some other person or persons is or are compelled by law to pay to me or to my executor in case of my disease all costs charges losses and expenses which I or him may be put unto lay out or expend in in consequence of such illness or any thing relating thereto and in case an action at law shall be necessary to be brought by my executor in order to obtain the amount of such costs charges losses and expenses or any part thereof

Then and in that case I direct that all the legatees under this my Will and my said executor shall each bear an equal proportion according to the respective amount or value given and bequeathed to each of them by this my Will of the trouble and expenses costs or charges thereby incurred and which shall actually be paid by my said executor and not received by him again from the said parish of Ottery Saint Mary or some other person or persons upon taxation of costs or otherwise

And in case my said executor shall by or in consequence of any unforeseen event or otherwise be compelled to the pay the amount of such costs charges and expenses out of my estate and effects and shall not receive the same again or in case any part thereof shall not be received from the said parish of Ottery Saint Mary or some other person or persons then and in that case I direct that all the legatees under this my will shall each respectively bear and pay the fair proportion of such costs charges and expenses according to the respective amount or value hereby by me given and bequeathed to him her and them respectively And I hereby empower my said executor to retain in his hands all the legacies hereby by me given until some adjustment or settlement of such costs charges and expenses be made

And I also empower him to deduct thereout the amount and fair proportions of such costs charges and expenses as aforesaid in case any shall actually be paid to him and not received again as aforesaid

In witness whereof I have to this my last Will and Testament set my hand and seal the day and year aforesaid Jon Voisey
