In the goods of Thomas Wescomb late of Cullompton in the county of Devon cordwainer
Appeared personally Thomas Wescomb of Hammersmith in the county of Middlesex yeoman and Robert Frost of Cullompton in the county of Devon, innholder the executors in trust named in the last Will and Testament of the said Thomas Wescomb who died on 5th day of June 1827
This is the last Will and Testament of me Thomas Wescombe of Cullompton in the county of Devon cordwainer I give and bequeath the following sums to the person hereinafter mentioned that is to say
To my nephew Thomas Wescombe the sum of five pounds
To my nephew James Wescombe the sum of ten pounds
To my nephew William Wescombe the sum of ten pounds
To my niece Mary Wescombe the sum of five pounds
To my niece Elizabeth Wescombe the sum of five pounds
To my nephew Matthew Robert Wescombe the sum of five pounds
To my nephew Robert Selby the sum of five pounds
To Matilda Westcombe widow of my nephew Robert Wescombe the sum of twenty pounds
To my niece Elizabeth Powel the sum of thirty pounds
To my niece Ann Watson the sum of twenty five pounds
To my brother in law Robert Mildon of Cullompton whitesmith the sum of five pounds
To my niece Maria Standerwick the sum of five pounds and to my great niece Matilda Wescombe the sum of sixty pounds and I direct my executors hereinafter named to pay the foregoing sums out of my personal estate within one year after my decease
I give and devise all my messuages lands and hereditaments wheresoever situate and whether freehold or for any other estate or term of years or which by virtue of any special power I am enabled to appoint by this my Will with their rights members and appurtenances to the use and in manner following that is to say
To the use and intent that my said niece Maria Standerwick and her assigns may receive during her life the sum of one shilling weekly and every week and to the further use and intent that my great niece Matilda Wescombe and her assigns may receive during her life the sum of two shillings weekly and every week and that both the same weekly sums be in addition to the legacies hereinbefore given to them and be clear of all deductions and abatements whatsoever to be issuing out of the said messuages lands and hereditaments hereinbefore devised and I hereby give to the said Maria Standerwick and Matilda Wescombe and their several and respective assigns such powers of entry and distress and sale upon the said messuages lands and hereditaments or recovering the said weekly sums if the same or any part thereof respectively shall be in arrear as are given to landlords for recovering rents reserved in common demise from subject thereto to the use of my nephew Thomas Wescombe of Hammersmith and Robert Frost of Cullompton aforesaid innholder their heirs executors administrators and assigns during the minority of my great nephew Samuel Wescombe son of the said Thomas Wescombe upon trust to pay and apply the rents and profits thereof unto and for the benefit of my said great nephew Samuel Wescombe and when my said great nephew shall attain his age of twenty one years then I give and devise the said messuages lands and hereditaments subject to the said weekly sums unto the said Samuel Wescombe his heirs and assigns forever
Provided always that in case either of my said trustees shall die or be desirous to be discharged from or refuse or be incapable to act in the trusts aforesaid it shall be lawful for the surviving or continuing trustee to appoint a new trustee to act with him and I do declare that the said trustees hereby appointed and to be appointed as aforesaid and the heirs executors administrators and assigns of them and each of them shall be charged and chargeable respectively for such monies only as they respectively shall actually receive by virtue of the trust hereby reposed in them and neither of them shall be answerable for the other of them or for involuntary losses and also that it shall be lawful for them out of any monies which shall come to their respective hands by virtue of the trusts of this my Will to retain to and reimburse themselves respectively and to allow each other all cost charges damages and expenses which they or either of them shall or may suffer sustain expend disburse be at or be put unto in or about the execution of the aforesaid trusts or in relation thereunto and also that it shall be lawful for my said trustees during the minority of my said great nephew by and out of the rent and profits of the said messuages lands and heredits to insure the house and buildings from fire and to repair the same respectively according to their discretion
All the rest and residue of the remainder of my estate real and personnel goods and chattels I give devise and bequeath unto my said great nephew Samuel Wescombe his heirs and assigns forever
Nevertheless I give unto my said great niece Matilda Wescombe and to my niece Maria Standerwick the choice of any article of household furniture not exceeding in the whole the value of five pounds for each of them and my said great niece to have the first choice from any said household furnishing
I hereby nominate and appoint the said Thomas Wescombe and Robert Frost executors of this my Will in witness whereof I have to this my Will contained in two sheets of paper set my hand to the first sheet and my hand and seal to this second and last sheet the thirtieth day of May in the year of our Lord one thousand eight hundred and twenty seven
