Proved 8th December 1840 in the Archdeaconry Court of Exeter

Appeared personally Ann Wyatt of Cullompton in the county of Devon widow the sole executrix named in the last Will and Testament of Christopher Wyatt of Cullompton aforesaid mason deceased who died on the 29th day of November 1840

This is the last Will and Testament of me Christopher Wyatt of Cullompton in the county of Devon mason

I give devise and bequeath unto my niece Ann Braddick daughter of Joseph Braddick of Ottery Saint Mary in the said county of Devon yeoman the sum of one hundred pounds to be paid her at the expiration of six calendar months after the decease of my dear wife Ann Wyatt and I charge (subject nevertheless as hereinafter is mentioned) all and singular my freehold and leasehold messuages or dwelling houses lands and premises situate in the said parish of Cullompton to and with the payment of the same and subject to the payment of certain mortgage debts now due and owing thereon unto George Pearse gentleman I give and bequeath the same messuage or dwelling houses lands and premises unto my said wife Ann Wyatt for and during the term of her natural life

And my will is and I hereby impower and direct my executrix hereinafter named to raise upon the mortgage of my said messuages or dwelling houses land and premises the sum of fifty pounds to be applied in supporting and maintaining (should there be occasion) the award of Charles Dacres Bevan esquire which he has lately made concerning certain matters in difference between myself and Mr James Nichols the elder

And I do hereby appoint and charge my said messuages or dwelling houses lands and premises with the payment of the said sum of fifty pounds and the interest thereof

And from and immediately after the decease of my said wife I give and bequeath the same messuages or dwelling houses lands and premises (subject nevertheless as aforesaid) unto by nephew John Wyatt son of my brother William Wyatt his heirs exors admors and assigns

And I give and bequeath all the rest residue and remainder of my real and personal estate and effects whatsoever and wheresoever unto my said wife Ann Wyatt her heirs exors admors and assigns for her and their own absolute use and benefit and I appoint my said wife Ann Wyatt sole executrix of this my Will

And lastly I hereby revoke all former Wills by me at anytime heretofore made and declare this to be my only true last Will and Testament in witness whereof I have here unto set my hand and seal this eighteenth day of November 1840 Christopher Wyatt

Signed sealed published and declared by the said Christopher Wyatt the testator as for and to be his last Will and Testament in the presence of us who at his request in his presence and also in the presence of each other have hereunto subscribed our names as witnesses hereto
