Proved in the Archdeaconry Court of Exeter 12th of June 1826
James Blackmore of [Morehayes?] in the parish of Cullompton in the county of Devon yeoman the executor named in the last Will and Testament of John Youd late of Cullompton aforesaid yeoman who died on the 5th day of January last
I John Youd of Cullompton Devon yeoman do make and ordain this to be my last Will Testament in manner and form following (that is to say)
In the first place I resign my soul unto almighty God trusting and assuredly hoping that by the mediation and intercession of our Lord and Saviour Jesus Christ I shall be pardoned of all my sins and transgressions
And as to such worldly goods and effects which God hath been pleased to bless me with I dispose thereof as follows
I give to my brother James Youd and to my sisters Ann Hussey and Elizabeth Carmel five shillings each to be paid by my dear wife Joan Youd within six months after my death
And I give devise and bequeath unto my said wife Joan Youd all my dwelling houses lands and premises whatsoever and wheresoever situated in Cullompton aforesd or elsewhere and all my monies securities for money goods chattels and effects whatsoever to hold unto my sd wife and to receive the rents issues interest produce and profits thereof for and during the term of her life
And from and immediately after her death then I give devise and bequeath all and singular my said messuage dwelling houses lands and premises wth the appurts unto my friend Mr James Blackmore of Moorhayes his heirs executors and admors in trust for sale as is hereinafter mentioned
And then also I give devise and bequeath unto the said James Blackmore all my said monies securities for money goods chattles and effects togr with the legal estate of all mortgages unto the said James Blackmore and do hereby appoint him executor of this my Will
Upon trust nevertheless that he the sd James Blackmore his heirs executors or admors do and shall with all convenient speed after the death of my sd wife sell and dispose of my messuages dwelling houses and premises either publicly or privately for the best price or prices that can be had or gotten for the same and pay and divide the money arising therefrom together with all other my said monies securities for money goods chattles and effects unto and amongst my sd brother and sisters in equal parts shares and proportions but it is my will and mind that no part thereof shall be subject or liable to the debts or control of the husband of my sd sisters or either of them but only for their own sole and separate use and benefit and that their respective receipts shall be a good and sufficient discharge for the same
And I do further declare that the purchaser or purchasers of my sd messuages lands and premises paying his or their purchase money to my said trustee and taken his receipt for the same shall be a sufficient discharge for such money and that he or they shall not be obliged to look to the application thereof or be accountable for the misapplication or nonapplication thereof
And I also direct that it shall be lawful for my sd trustee to retain and reimburse himself all such reasonable charges and expenses as he shall lay out and expend in the management and execution of the trust hereby reposed in him
In witness whereof I the said John Youd have hereunto set my hand and seal the fifteenth day of April in the year of our Lord one thousand eight hundred and nine The mark of John Youd
Signed sealed published and declared by the sd John Youd as and for his last Will and Testament who at his request have subscribed our names as witnesses hereto in his presence and of each other of us
